 THE MINNEHAHA COUNTY COMMISSION CONVENED AT 9:00 AM on August 27, 2024, pursuant to adjournment on August 20, 2024. COMMISSIONERS PRESENT WERE: Bender, Bleyenberg, Karsky, and Kippley. Special Personnel Actions
1. To approve the conversion of two attorney positions in the State's Attorney's Office to senior trial attorneys.
PURCHASE AGREEMENT
Steve Groen, Highway Superintendent, presented a request to consider bid results and award a recommendation for the purchase of a side dump trailer and authorize the Chair to sign a purchase agreement with DMI, Inc. Bids were opened on March 13, 2024, for the purchase of a side dump trailer. During the March 19th Commission meeting, the Commission awarded the bid to Diesel Machinery, Inc (DMI) for $65,625 and authorized the Highway Department to purchase one new trailer. The new unit was purchased and is in service. During the annual DOT inspection of the other side dump trailer, the inspector found that the kingpin pull plate is bent, and a crack was also discovered in a crossover weld. The Highway Department contracted DMI and the bid received earlier this year is still valid. The replacement of this trailer was in the Highway Department FY 2024 budget, but was removed at the January 2, 2024, Commission meeting to purchase a Bobcat skid loader. The Highway Department is under budget in construction expenses for FY 2024 and will be able to pay for this unit from our existing budget. The Side Dump Tri Axle Side Dump trailer will primarily be used to haul materials through Minnehaha County. The new unit will replace Unit #3514, Asset #0463, a 2004 Trail King Side Dump Trailer. MOTION by Kippley, seconded by Bender, to Approve Bid Results and Award Recommendation for the Purchase of a Side Dump Trailer and Authorize Chair to Sign a Purchase Agreement with DMI, Inc. TRANSFER AGREEMENT
Joe Bosman, Captain, presented a request for authorization to have the Commission Chair sign a transfer agreement with the City of Sioux Falls for the Hartford Radio Tower. During the derecho storm in May 2022, the public safety communications tower located northeast of Hartford, SD, and owned by Metro Communications was blown down. This tower site functioned as a prime location for radio communications network utilized by state and county law enforcement, fire departments, EMS, and highway departments. The tower was insured by Metro Communications and the replacement costs for the insurance claim are still available to be used to replace the tower. Since Metro Communications ceased to exist as a separate legal entity effective as of January 1, 2024, and is now an office under the City of Sioux Falls, a transfer agreement is needed for Minnehaha County to receive funds from the insurance company and to utilize the funds towards the construction of the replacement tower. The amount of insurance funds estimated to be received is approximately $95,000 with the replacement cost to construct a new tower being $100,414. The agreement with the City allows for the County to use the insurance proceeds and begin getting the tower replaced. A continued partnership will exist with an allowance for the City to place two antennas on the new Hartford tower. This mutually beneficial agreement will ensure our first responders are equipped and capable to respond to emergencies with clear and effective radio communications. MOTION by Bleyenberg, seconded by Kippley, to Authorize the Chair to Sign the Transfer Agreement with the City of Sioux Falls for the Hartford Radio Tower. By roll call vote: 4 ayes.
Joe Bosman, Captain, presented a request for authorization for the Commission Chair to sign a transfer agreement with the City of Sioux Falls for the West Baltic Radio Tower. As part of our county wide radio infrastructure improvement project, one of the tower sites is west of Baltic, SD. This location fits well into our communications network as a prime location for the radio communications network utilized by state and county law enforcement, fire departments, EMS, and highway departments. This location was previously owned by Metro Communications, and later transferred to the City of Sioux Falls for use by their water division. There is currently a 150 foot guyed wire tower and a small wooden equipment shelter on this property, but both are aged and not adequate to be used for the necessary antennas and highly technical equipment we have committed to use as part of the communications network expansion. Minnehaha County has constructed a new equipment shelter on the site, and is now ready to proceed with the replacement of the 150-foot monopole. The transfer agreement with the City of Sioux Falls officially transfers the property to Minnehaha County. In addition, the transfer agreement reflects a continued partnership between the City and County with an allowance for the City to place two antennas on the West Baltic tower and the city agreeing to equally divide the cost of constructing a new tower (up to $50,000 for the city's portion). The new West Baltic Tower proposal costs $97,670. This mutually beneficial agreement will ensure our first responders are equipped and capable to respond to emergencies with clear and effective radio communications. As part of the Minnehaha County Public Safety Radio Tower Expansion Project, one of the needed radio tower sites is located northeast of Hartford, SD. This location has already had prep work started by utilizing previously approved American Rescue Plan Act (ARPA) funds. At this location, a 150-foot monopole tower will be constructed on land that the county currently leases specifically for this purpose. Sabre Industries is the current radio tower vendor approved by the State of South Dakota Bureau of Administration through a competitive price agreement and this designation ensures that current county procurement practices are followed. The cost proposal from Sabre Industries for the Hartford site is $100,414, which includes tower materials, foundation installation, and tower erection. Site work has already begun at the Hartford location with new utilities installed and an equipment shelter constructed. The new tower is a replacement of one owned and insured by Metro Communications that was destroyed during the derecho storm event on or about May 12, 2022. The City of Sioux Falls has agreed to use all reasonable efforts to obtain the full insurance proceeds and transfer all such insurance funds, once the funds are received, to Minnehaha County, which is estimated to be around $95,000. With the approval and signature of this proposal from Sabre Industries, the Sheriff's Office will work with Sabre to get a new tower erected on the site so our first responder communication antennas can be installed on it. Sabre Industries is the current radio tower vendor approved by the State of South Dakota Bureau of Administration through a competitive prices agreement and this designation ensures that current county procurement practices are followed. The cost proposal from Sabre Industries for the West Baltic site is $97,670 which includes tower materials, foundation installation, and tower erection. The City of Sioux Falls will also benefit from this newly constructed tower as they plan to have a couple of antennas on the tower related to their water department. In consideration of their nonexclusive space on the West Baltic tower, the City of Sioux Falls has agreed to cover 50% of the new tower construction costs (total construction costs not to exceed $100,000). Site work has already begun at the Baltic location with new utilities installed and an equipment shelter constructed. With the approval and signature of this proposal from Sabre Industries, the Sheriff's Office will work with Sabre to get a new tower reacted on the site so our first responder communication antennas can be installed on it. COMMISSIONER LIAISON REPORTS
Commissioner Bleyenberg reported on the upcoming joint budget hearings with the City of Sioux Falls.
Commissioner Bender provided an update on the construction at the Juvenile Justice Center and also reported that renewal notices for the Juvenile Justice Center partners have been sent.
Commissioner Kippley reported on the recent meeting of the Minnehaha County Planning & Zoning Commission as well as the quarterly meeting of the Public Defender Office Advisory Board.
Commissioner Karsky reported on the quarterly meeting of the Public Defender Advisory Board.

JOINT BUDGET HEARINGS
Bill Hoskins, Museum Director, presented the Siouxland Heritage Museum 2025 budget. The requested operations budget is $1,643,570, to be equally split between the City of Sioux Falls and Minnehaha County. The City of Sioux Falls will provide $38,950 for the Pettigrew Museum Maintenance. Minnehaha County will provide $63,100 for the Old Courthouse Museum Maintenance. The Irene Hall Museum Resource Center requested a maintenance budget of $52,500 and will be equally funded by both the City of Sioux Falls and Minnehaha County. The proposed budget also includes the Museum Special Enterprise Fund at $305,229 and the Museum Store Fund at $21,950. MOTION by Bleyenberg, seconded by Bender, to Approve the 2025 Museum Operations, Pettigrew Museum Maintenance, Old Courthouse Museum Maintenance, Irene Hall Museum Resource Center Maintenance, Museum Special Enterprise Fund, and Museum Store Fund budgets as Presented. By roll call vote: 4 ayes. The City concurred.
