THE MINNEHAHA COUNTY COMMISSION CONVENED AT 9:00 AM on February 18, 2025, pursuant to adjournment on February 4, 2025. COMMISSIONERS PRESENT WERE: Beninga, Bleyenberg, Heisey, Karsky, and Kippley. COMPREHENSIVE PLAN
Scott Anderson, Planning & Zoning Director, was present for the public hearing and gave the second reading for the 2045 Envision Comprehensive Plan. State law requires that a comprehensive plan be adopted before a county can enact zoning controls. A comprehensive plan also serves as a blueprint for how the county will handle growth and establishes policies for land use. The County Commission was given updates on the development of the comprehensive plan during meetings held in August and October 2024. The current 2035 Plan was adopted on June 16, 2015. After approximately one year of meetings before the Planning Commission to present the updated chapters and 3 months of density task force meetings, the Envision 2045 Plan is complete. The updated comprehensive plan was presented to the Planning Commission during the September 23, 2024, meeting along with a public hearing held during the November 25, 2024, meeting. Public input meetings were also held in Dell Rapids, Brandon, and Hartford. The 2045 Envision Comprehensive Plan includes the following chapters: Introduction; Population & Employment Analysis; Existing Land Use Analysis; Growth Management; Rural Conservation; Environmental Stewardship; Transportation; Future Land Use Plan; Implementation; and Appendix. The Planning Commission unanimously voted to recommend adoption of the Envision 2045 Comprehensive Plan.

PRESENTATION
Scott Anderson, Planning Director, presented the annual presentation for the Planning/Parks Department. The presentation provided an overview on the activities that have been completed by the Planning Department as well as current activities. The completed activities include Building & Septic Permits/Inspections; Code Enforcement & CUP Inspections; Digitized Historical Meeting Minutes, Agendas, and Building Permits; Updates to the Permit Application Packets, Information Brochures, and Other Various Information on the County Website; Creation of a New Online Customer Satisfaction Survey; Review of the New Preliminary Floodplain Maps Submitted by FEMA; a Planting of New Trees at Wall Lake Park, and Updates to the Internal Permitting, Property Management, and Receipt System as the continued work on the Comprehensive Plan Update. The presentation went on to highlight the parcel manager conversion and the Envision 2045 Comprehensive Plan. Some of the highlights of the current activities include various inspections, staff reports & site visits, general inquiries & zoning explanations; adopting regulations for short-term rentals, long-term rentals, and Intermodal Shipping Containers with the Dell Rapids Joint Zoning Area as well as the Envision 2045 Comprehensive Plan; drafting Ordinance Amendments for Accessory Dwelling Units (ADUs) and Proposed Change to the Transfer of Building Eligibility Regulations as continue to work on the Parcel Manager Migration. Finally, Planning Director Anderson went on to highlight the various statistics for the past year and future projects.

PRESENTATION
Kris Swanson, Treasurer, provided an annual presentation on the Treasurer's Office and highlighted the handful of changes and a series of new beginnings for the office as well as the completed activities and current activities for the office. The presentation went on to highlight the various statistics for the office, including title count for the past three years; registrations for the past three years, as well as the breakdown of registrations for each month in 2024. The presentation went on to present information regarding the mail fee, NSF balance, and the phone log for the past three years. Finally, the presentation provided information on the calendar year registrations completed at the kiosks in the County as well as the transaction count, along with a comparison to the past calendar year. Treasurer Swanson also thanked the staff for the work that they do and the excellent customer service that they provide.

GRANT AGREEMENT
Tom Greco, Commission Administrative Officer, presented an agreement between Minnehaha County and the John D. and Catherine T. MacArthur Foundation for the Safety and Justice Challenge Capstone Grant. The amount of the grant is $250,000 for the use over the period of January 1, 2025, through December 31, 2026. This grant represents the fourth grant awarded by Minnehaha County by the MacArthur Foundation's Safety and Justice Challenge. The grant is intended to strengthen efforts begun under previous grant cycles and will focus on: 1)implementation of Think 3D's "Bridges" program which provides a re-entry model to engage justice involved individuals while incarcerated in and upon release by immediately connecting them to a Leaders of Tomorrow-Justice Impacted cohort; 2) strengthening community engagement by hosting four neighborhood block parties; 3)enhancing South Dakota Urban Indian Health's street outreach program, Wo'okiye, which provides various outreach and case management services; and 4)program management and reporting support to meet the terms of the agreement. Professional Service Agreements with Think 3D, South Dakota Urban Indian Health, and USD's Center for Rural Health Initiatives for implementation of the aforementioned items will be presented during future meetings. Jacob Maras, Interim Highway Superintendent, reported on the bid opening for Project MC25-04 Microsurfacing and Crack Seal held on February 5, 2025. The project was bid with a base bid and three optional alternates. After a review of the bid prices, it was determined that only the base bid and alternate 1 will be awarded. This project will crack seal and microsurface 32.57 miles of county and include county highways 104, 118, 122, 140, 146, 148, 150, & 151. The following bids were received: ASCO with a base bid of $1,480,639.53 and Alternate 1 bid of $446,098.29 for a total bid of $1,926.737.82; Asphalt Surface Technologies Corp. with a base bid of $1,597,848.29 and Alternate 1 bid of $491,638.03 for a total bid of $2,089,486.32; and Missouri Petroleum with a base bid of $2,483,392.04 and Alternate 1 bid of $732,800.52 for a total bid of $3,216,192.56. AGREEMENTS
Jacob Maras, Interim Highway Superintendent, presented authorization for the Chair to sign a Joint Powers Agreement with the South Dakota Department of Transportation for the Reconstruction South Dakota Highway 11 and County Highway 130. The South Dakota Department of Transportation has identified two structures on South Dakota Highway 11 for reconstruction. The updated design of these two structures requires a road grade raise that will affect County Highway 130. County Highway 130 will be reconstructed by the State approximately 0.1 miles west and 0.2 miles east of SD11. There is no cost to Minnehaha County for the reconstruction of County Highway 130 and the County will coordinate the work required to tie into the BNSF rail crossing on County Highway 130. Meredith Jarchow, Assistant Commission Administrative Officer, provided an update for the 2025 Legislative Session. Some important dates to note regarding the Legislative session are February 24, which is the last day to move required delivery of bills or resolutions by a committee to the house of origin, and February 25, which is the last day to pass bills or joint resolutions by the house of origin. The briefing went on to summarize the legislation that the Commission Office is following. The briefing included information on the following House Bills (HB) 1208, 1220, 1221, 1228, 1229, 1235, 1246, 1249, 1250, 1251, 1261, and 1267. HB 1208 would provide for registration of an overseas citizen or individual using the address of a mail forwarding service or post office box as a national voter. HB 1220 would amend provisions pertaining to the verification of registered voters contained in the master registration file. HB 1221 would make an appropriation for victim services provided by nonprofit organizations. HB 1228 would require an environmental impact statement from applicants seeking a carbon dioxide transmission facility permit from the Public Utilities Commission of the State of South Dakota. HB 1229 would provide an exemption from certain property taxation for owner-occupied single-family dwellings, and to limit the taxes due on property over the previous year. HB 1235 would reduce the limit on the annual increases of property tax revenue payable to certain taxing districts, and to subject school districts to a limit on property taxes collected in a year. HB 1246 would require the director of equalization to adjust certain agricultural land values. HB 1249 would protect landowners from the use of deception, fraud, harassment, intimidation, misrepresentation, or threat, in acquiring easements for linear infrastructure. HB 1250 would require certain provisions related to proof of service of legal documents. HB 1251 would establish the minimum compensation for an easement obtained through the exercise of eminent domain for a project affecting multiple landowners. HB 1261 would provide the board of commissioners with authority over certain intra-county land uses and construction projects. HB 1267 would prohibit the use of paid petition circulators and provide a penalty therefor. The briefing went on to highlight the following Senate Bills (SB) 188, 190, 191, 194, 202, 207, 208, 211, 212, 216, 217, and 218. SB 188 would amend eligibility to vote by absentee ballot. SB 190 would provide school choice through an education tax credit. SB 191 would limit annual valuation increases on owner-occupied single-family dwellings. SB 191 would limit annual valuation increases on owner-occupied single-family dwellings. SB 194 would classify nicotine products as tobacco products, to increase tax rates on cigarettes and tobacco products, to create the healthcare workforce development fund, and to make an appropriation therefor. SB 202 would create an infrastructure development fund. SB 207 would freeze property tax revenues and assessments for two years. SB 208 would amend provisions pertaining to a school district's proposed opt out, capital outlay certificate, and other agreement. SB 211 would revise and clarify the notice and hearing procedures of the Public Utilities Commission. SB 212 would require that pipeline applicants acquire county permits prior to submission of a permit application to the Public Utilities Commission. SB 216 would reduce the growth in the assessed value of owner-occupied property tax assessments. SB 217 would prohibit the use of automatic tabulating equipment. SB 218 would revise provisions associated with residency voting purposes. The following bills were mentioned as Hog House legislation HB 1134, 1135, 1149, 1150, 1167, 1168, 1170, and 1241 along with SB 136, 137, 138, 148, 149, 150, 151, 152, 198, and 199. Finally, the briefing highlighted HJR 5005 proposing and submitting to the voters at the next general election an amendment to the Constitution of the State of South Dakota, limiting the assessed value of real property and limiting real property taxes, and SJR 506 proposing and submitting to the voters at the next general election an amendment to the Constitution of the State of South Dakota, limiting to a flat rate the real property tax.

Commissioner Heisey reported on meetings with representatives from the Abandoned Cemeteries, Inter-Lakes Community Action Partnership, and Minnehaha County Conversation District, as well as the opportunity to learn about the County through the liaison assignments.
Commissioner Bleyenberg reported on the meeting with the Accessible Housing Advisory Board and the opportunity to learn about the County through the new liaison assignments.
Commissioner Karsky reported on the meeting with County Funeral Directors and Sioux Metro Growth Alliance Membership Advisory Board meeting.
Commissioner Beninga reported on recent and upcoming meetings regarding the Juvenile Justice Center, Office of the Public Advocate, Sioux Empire Fair Board as well as Highway Superintendent interviews.
Commissioner Kippley reported on a recent meeting with the Office of Public Advocate.
