October 3, 2024 Legion Report

            The Henry G. Fix Post 23 meeting opened on Thursday, September 3rd at 7:56 pm.  The meeting was opened by Commander Jon Schmidt with a salute to the Colors, POW/MIA observance, the Pledge of Allegiance, and Preamble to the American Legion Constitution.  Chaplain Lampe offered the prayer.  24 members were present. 

            The Sons of the American Legion were present as our special guests.  Representing the detachment was South Dakota Commander Shane Lamer, and Jesse Kindelspire.

            Jesse is working with Scout Cooper Rey on a database of all Veteran’s graves in the four largest cemeteries in Sioux Falls.  Data will include pictures of headstones and GPS locations.  He is looking to add other rural cemeteries.  The American Legion Adjutant will work with Jesse to add the eleven cemeteries that Post 23 supports.     

            The minutes of the previous meeting were presented and approved. The finance and social reports were approved.  Bills were approved for payment. 

            Service Officer Nancy Grandy reported that get well cards were sent to Neal Albers and Steve Frerk.  Nancy passed out the October newsletter.  Nancy highlighted Mark Williamson’s future attendance on the Mission 21 Honor Flight.  Our Auxiliary will be hosting a fundraiser on October 18th. 

            The membership report was given by Nancy Grandy.  She reported that our 2025 goal is 201 members.  Our October goal is 55% (111 members).  We currently have a total of 115 renewed members (57%) at this point.  Our November goal is 131 members.

            Nancy Grandy passed out the Meals with Veterans forms for the school.  The Adjutant brought up the Department Commanders camping scholarship program.  A motion passed to sponsor a scout for $400.   

            Brian Siemonsma gave the baseball report.  The Department of South Dakota VFW has named the Garretson Baseball Association as a Friend of South Dakota VFW Baseball.  The Garretson Baseball Association was awarded $500 for their positive attitudes and for hosting the 14U tournament. 

            The bathrooms were discussed.  There is only caulking left to complete.   

            The Vietnam Vets Legacy MC Poker Run started their ride at our Post on Saturday, September 7th.  Josh Lampe thanked the Post for hosting and reported a nice turnout for the event. 

            Our next Post meeting will be Thursday, November 7th with the meal at 7 pm and meeting at 8 pm.  The next Post breakfast will be October 6th from 9 am to 1 pm with scrambled eggs and ham.  The next County meeting will be held in Dell Rapids on October 29th with a start time of 7 pm.  The next District meeting will be held October 26th in Dell Rapids with a social at 11 am, meal at noon, and meeting at 1 pm.

            Beth Welch asked if the final football meal could take place at the Legion on Thursday, October 17th.  A motion passed to approve use of the building.

            Sons of the American Legion Commander Shane Lamer spoke about their organization.  They are the fastest growing organization within the Legion.  They have over 400,000 members nationwide.  South Dakota has opened 16 new detachments in the last 4 years.  Shane would like to see Garretson start a detachment.  Andy Lyngen endorsed Shane’s comments and supports forming a detachment. 

            The monthly raffle drawing took place.  There were 5 drawings for October.  Winners were:  Ben Johnson, Deanna Hentges, Maggie Hall, Deb Sundem, and Tyler Engebretson.  Each will receive $150!

            Commander Jon Schmidt closed the meeting with the usual ceremony at 8:49 pm.

            The Splitrock Ladies bowled on October 8th, 2024, with the following results:

 High Team Game & Series - Rock River Ag, LLC - 899 & 2480.

             High Individual Game - Marcia Bork & Cheryl Scholl each had a 186.

             High Individual Series - Jill Reindl – 457.

             Amy Caldwell picked up the 4-7-9 split.

            Cheryl Scholl picked up the 2-7 & 4-5 splits.

            Marcia Ryken picked up the 4-5 split.

            Renee Nelson picked up the 6-7 & 2-7 split.

Obituary: Keith D. Jones age 73

            Keith D. Jones age 73 , of rural Sioux Falls, SD, passed away Tuesday, October 8, 2024, at Avera McKennan Hospital in Sioux Falls, SD.

            Memorial service will begin at 11:00 AM, Thursday, October 17, 2024, at the Minnehaha Funeral Home in Garretson, SD with Pastor Corey Scott officiating. Burial will take place at a later date.

            Visitation with family present will be Wednesday, October 16th from 5 :00 PM – 7:00 PM at the Minnehaha Funeral Home in Garretson.

             The Garretson American Legion will provide full military honors at the Funeral Home following the memorial service.

In lieu of flowers, family prefer memorials.

Keith Jones was born July 9, 1951 in Garretson, SD to Gordon and Grace (Eads) Jones. He graduated from Garretson High School and entered the United States States Army serving in Viet Nam.

            On June 16, 2011 he was united in marriage to Teri Pritchard. They made their home near Corson, SD. Keith worked as a foreman and retired from the Sweetmen Construction Sand and Gravel company in Corson, SD for over 40 years.

            Keith was an avid fisherman and hunter. He loved riding his motorcycle and was very proud of his yard that he would take care of in his free time. He loved helping neighbors and friends and was always doing something outside. Keith was the most amazing husband and dad and would always make time for family and friends

            He is survived by his wife, Teri; daughter Haylee (Ali Elkafifi) of Sioux Falls; mother-in-law, Janice Eidsness of Sioux Falls; brother and sister, Galen and Lauri McGee of Sioux Falls; sister-in-law, Cathy Jones; niece, Jamie Jones and nephews, Joe and Max Jones,and other extended family members.

            Keith was preceded in death by his parents, Gordon and Grace Jones; brothers, LeRoy, Rodney, Larry and Claude; and step-mother, Esther Jones.

Obituary: Thomas LaMoyne Godbey, age 76

            Thomas LaMoyne Godbey was born to parents LaMoyne and Doris (Frank) Godbey on May 28, 1949, in Brookings, SD. He passed away unexpectedly at his home on October 8, 2024. Mass of Christian Burial was held on Saturday, October 12, 2024, at St. Rose of Lima Catholic Church in Garretson. Interment was in the church cemetery. In lieu of flowers Tom requested donations be made to Garretson Fire Department, Garretson Ambulance, Blue Dragon Foundation, or The American Legion.

            Tom attended school in Garretson, SD graduating with the class of 1968. He attended Pipestone Vo-Tech for one year, earning a degree from the meat cutting program. Tom held various jobs throughout his life. He was a meat cutter at the Sunshine Foods, owned and operated Godbey's Market in Garretson, dug ditches for Kemp Excavating, worked at Bayliner in Pipestone, MN, and owned and operated Tom's TbarK in Garretson. His part time job of 30+ years was custodian at St. Rose. The last position he held was as a forklift operator at Sullivan's, Inc in SFSD, where he worked for 28 years, retiring in 2015. He soon decided that he couldn't be idle, got his CDL and a job driving a bus for the Garretson School District, where he was still employed at the time of his death.

            Tom was proud to say that he was a third-generation meat cutter, second-generation city council member and second-generation bus driver. Tom was proud to work as a bus driver, transporting students on a daily basis, as well as sports teams in the evenings and on weekends. He was active in community organizations, serving on the city council for several years. His passion in that capacity was the maintenance and further development of the Split Rock Park. He was a charter member of the Garretson Jaycees and a driving force behind the development of the softball complex. He played ball for The Pomp Room, hosting many tournaments in Garretson. He was a lifetime member of St. Rose of Lima, serving the church in many ways.

            Tom's hobbies and pastimes included sports, golfing, fishing, gardening and camping. But most of all, he loved spending time with family. When camping, he cooked most meals over an open campfire, while enjoying a few "cold ones" with family and friends. Tom was an avid fan of the Garretson Blue Dragons, Notre Dame Fighting Irish and the Minnesota Twins. He was passionate about recycling in every way possible.

            Tom met his wife, Karla (Schaefer) Godbey in Brewster, MN in October,1980. He often stated that she was the best thing to ever happen to him. They were married on May 30, 1981, at St. Rose in Garretson. Tom and Karla were blessed with three loving children; Danielle, Meghan and Derrick.

            Tom was preceded in death by his parents, sister Mary Ellen Pierret, and brother Jim. He is survived by his wife Karla (Schaefer) Godbey, children Danielle (Sam) Swenson, Sioux Falls, Meghan (Matthew) Menely, Round Rock, TX, and Derrick (Samantha) Godbey, Garretson. He is also survived by grandchildren Theo Menely, Sawyer and Delaney Godbey, Elijah and Archer Swenson as well as sisters Cheryl (Larry) Neustal, Jeanne (Larry) Robins, and Gayle Franka, brothers in law Danny (Jackie) Schaefer, Marshall, MN, and Chuck (Laure) Schaefer, Eagan, MN, along with several nieces and nephews.

Obituary: Rosella Evonne Gilbertson, 82

            Rosella Evonne Gilbertson, 82, peacefully passed away while her son Soren held her hand Tuesday, September 10th, 2024 at St Joseph Hospital Denver, Colorado. One of Toots wishes was to be buried next to her mother at Norway Cemetery. A graveside service will be held Saturday October 19, 2024 at 11:00 am at Norway Cemetery, rural Garretson with family and friends all invited. Lunch will follow at the Yvonne Larson home in Garretson.

            She was born to Edwin "Eddie" & Margaret Larson February 16 1942. She had two Siblings an older sister Ruby Schroder and Raymond Larson. Lovely known as "Toots" being the youngest she was loved and "spoiled rotten". Toots attended District 126 Hegge Country School and graduated from Garretson High School in 1960. She attended Augustana University and The University of the Philippines.

            Toots had a God given gift of music. She was granted a scholarship to Augie and played piano with the South Dakota Symphony for a short time. She brought joy to everyone she met and you could describe Toots in one word "Cool".

            Later on she married Dan Gilbertson at Zion Lutheran Church in Garretson. Her son Soren joined shortly after. Dan & Rosella divorced after which it was Toots & Soren taking on the world, eventually settling in Colorado. Toots was always devoted to God, blessed to worship, and always saw the spirit of God's love.

            One of Toots last public performances was at her brother Ray's funeral where she played one of his favorite songs on the piano beautifully. Rosella is survived by her son Soren Gilbertson, Denver Colorado. Sister Ruby (Bob) Schroeder Hutchinson, MN. Sister-in-law Yvonne Larson Garretson. Many nieces and nephews and lots of friends. She was preceded in death by her father Eddie, mother Margaret, and brother Raymond.

Obituary: Clarissa Mae Breyfogle, age 87

            Clarissa Mae Breyfogle, age 87, passed away peacefully in her sleep, at her home in Garretson, SD on Saturday October 5, 2024.

            Mass of Christian burial was held at 11:00 AM on Friday, October 11, 2024, at St. Rose of Lima Catholic Church in Garretson, SD with Fr. Kevin O’Dell celebrating.  Inurnment will take place at a later date at Hills of Rest Cemetery in Sioux Falls, SD.

            In lieu of flowers, family wish memorials to be directed to the Garretson Food Pantry.

Clarissa was born April, 16, 1937 in Slayton, MN to Clarence and Mabel (Peterson) Wigton. On April 16, 1956, Clarissa was united in marriage to James Breyfogle in Marshall, Minnesota. In 1976, Clarissa and James moved their family to an acreage near Garretson, SD; where Clarissa was able to have a beautiful flower garden and enormous vegetable garden where she would spend hours.

            Clarissa was a devoted Christian, wife, mother, grandmother, great grandmother, and great-great grandmother. She had a love of family that brought her so much joy to her life. She enjoyed riding horses on trail rides, playing cards and games, sewing clothes, and traveling. Clarissa enjoyed spending many weekends up at Lake Shetek with family and being out on the water. She enjoyed watching grandkids in various activities.

            Grateful for having shared her life was the love of her life and husband, James, until his death in 2007; Five children, James Breyfogle of Sioux Falls, SD, Mary Lane of Garretson, SD, Rebecca (Dean) Caton of Yankton, SD, Chuck Breyfogle (Mary D.) of Garretson, SD, and Cindy (Dean) Olson of Sherman, SD; 16 grandchildren; 17 great grandchildren; and two great-great granddaughters; sisters Jean Popowski of Staples, MN; and Betty Wigton of Brandon, SD.

            She was preceded in death by her parents; husband; and siblings, Louis, Lee, Joyce, Clarence, and Jerry; grandson, Keith Lane; great grandson Hayden Caton.

            The City Council of the City of Garretson, Minnehaha County, South Dakota met in regular session on Monday, October 7th, 2024, at 6:30 p.m. at Garretson American Legion with Mayor Brown presiding.

            PUBLIC COMMENT: D. Myers presented reasons for council to revise proposed Ordinance 703. Mayor Brown advised city staff has revised ordinance and plans to present in tonight’s meeting.

COMMITTEE REPORTS:

•          Natural Gas Reports – Dreckman advised council gas prices at $0.85 per ccf. Council member Beaner motioned to approve natural gas prices with a second from council member Godbey. 5 ayes (Kientopf, Beaner, Godbey, Bonte) 0 nays, 1 absent (Rotert). Motion passed.

•          Finance – Dreckman presented balances for city finances and advised the council on days City Hall will be closed due to SDML Conference. No discussion was had.

•          Streets/Maintenance/Parks – Doane and Gebhart gave update on 4th Street Improvement Project. Doane advised natural gas line installations he is planning for the coming weeks J. Hofer advised council on Split Rock Park improvements. J. Hofer gave update on Building Permits currently.

•          Code Enforcement – J. Hofer gave update on items being worked through Code Enforcement Officer.

•          Economic Development – Fields gave update on activity for September and what is to come in October.

•          Emergency Services (Garretson Fire, Minnehaha Co Sheriff, Garretson Ambulance) – Heitkamp gave update with 148 calls year to date for fire department and 28 department members currently. Mayor Brown read through quarterly report provided by Minnehaha County Sheriff's Office

ORDINANCE NO. 697

            AN ORDINANCE OF THE CITY OF GARRETSON, SOUTH DAKOTA, AMENDING CHAPTER 51 OF THE CITY OF GARRETSON, SOUTH DAKOTA.

            BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF GARRETSON, SOUTH DAKOTA, THAT SECTION 51.36, Existing System and New Land Requirements, OF THE GARRETSON SEWER ORDINANCES (AS ADOPTED BY ORDINANCE NUMBER 625 and passed on February 1, 2016), IS AMENDED IN ITS ENTIRETY AS FOLLOWS:

Section 51.36  Existing System and New Land Requirements.

            A.         All existing septic tanks shall be considered non-conforming uses and therefore may not be replaced.  Any new construction or substantial improvement must be connected to the City’s sewer system. Additionally, if the existing septic system causes the ground water to become polluted, allows wastewater to surface, causes a health hazard, or fails to meet the requirements of any other section herein, the Building Inspector and Utilities Superintendent shall require that the property at issue be connected to the City’s sewer system. 

            B.         Lot size exception and flow restriction as determined by Building Inspector and Utilities Superintendent:  When constructing a personal residence within the city limits you must hook up to and utilize the city sewer system.  Qualifying lots must be approved by the Building Inspector and Utilities Superintendent prior to construction and installation.  If said lot size is one acre or more and city sewer system is deemed inaccessible by the Building Inspector and Utilities Superintendent, a septic system may be constructed. If mechanical means (a pump), or installation of 250 feet or more of sewer line is deemed necessary to utilize the city sewer system, a septic system may be constructed. Constructing and installation of the septic system must be completed by a certified installer, as required by the Administrative Rules of the state. All usage of the septic system must be documented and submitted to City Hall by January 15 each year. 

            Section 2. All ordinances and parts of ordinances in conflict with this ordinance are herby repealed. This ordinance shall be in full force and effects from and after its approval, adoption and publication as provided by law.

ORDINANCE NO. 702

            AN ORDINANCE OF THE CITY OF GARRETSON, SOUTH DAKOTA, AMENDING CHAPTER 71 OF THE CITY OF GARRETSON, SOUTH DAKOTA.

            BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF GARRETSON, SOUTH DAKOTA, THAT SECTION 71.04, Campers, Motor Homes, Boats, and Trailers Restricted OF THE GARRETSON PARKING RULES ORDINANCES (AS ADOPTED BY ORDINANCE NUMBER 640 and passed on October 1st, 2018), IS AMENDED IN ITS ENTIRETY AS FOLLOWS:

            Section 71.04 Campers, Motor Homes, Boats, and Trailers Restricted

            A.         No person shall park any boat, camper, motor home, trailer, or any other type of vehicle other than a motor vehicle on any street within the City for a period of longer than seventy-two hours during the months of May through October.  These same vehicles shall be prohibited from parking on any street within the City during the months of November through April.

            B.         Parking of any boat, camper, motor home, trailer, or any other type of vehicle other than a motor vehicle, on any street within the City is allowed for no more than seventy-two hours for cleaning, loading, and unloading only.

Penalty

            Any vehicle described herein, other than a motor vehicle, that is parked in violation of this section shall be first tagged with a warning citation, listing the date of the offense, license number of the vehicle, make, violation number, and location of offense with reference to street.  The owner of said vehicle shall have no more than 72 hours to remove the vehicle from the street.  If the owner of said vehicle fails to remove it from the street within the 72-hour timeframe, the City may issue a citation imposing a fine not to exceed $100.00, which fine must be paid by taking such citation to the City Office and depositing the fine payment with the City Finance Officer.  The amount of the fine shall be at the discretion of the code officer or law enforcement officer issuing the citation.  Each day of violation is considered a separate offense.  If the owner or operator fails to comply within seven days from the date of the citation, a summons requiring appearance at the City Office and payment of the fine will be issued.  If the summons is not complied with, a warrant may be issued to bring the owner into court and the fine plus court costs will be assessed by the court for the violation.  Any vehicle described herein, other than a motor vehicle, may be removed from the streets by a code officer or a law enforcement officer and placed in public or private storage and owner thereof, in addition to the fines and penalties provided herein, shall pay the charges for towing and storage of said vehicle.  

Section 2. All ordinances and parts of ordinances in conflict with this ordinance are herby repealed. This ordinance shall be in full force and effects from and after its approval, adoption and publication as provided by law.

ORDINANCE NO. 703

            AN ORDINANCE OF THE CITY OF GARRETSON, SD, AMENDING THE MUNICIPAL ORDINANCES OF THE CITY OF GARRETSON, SD, BY AMENDING TITLE 7, TRAFFIC, CHAPTERS 74.30 BICYCLES AND ALL-TERRAIN VEHICLES; 74.31 BICYCLE OPERATION REQUIREMENTS; 74.99 PENALTY

            BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF GARRETSON, SD:

            That Section 7-74.30 to 74.99, of the Municipal Ordinances of Garretson, SD, is hereby amended to read as follows:

            OFF-ROAD VEHICLES

            74.30 DEFINITIONS

            For the purposes of this article, the following terms, phrases, words and their derivations shall have the meaning given herein:

            OFF-ROAD VEHICLES: means any self-propelled, two or more wheeled vehicle designed primarily to be operated on land other than a highway and includes, but is not limited to, all-terrain vehicles, dirt bikes, dune buggies, and any vehicle whose Manufacturer’s Statement of Origin (MSO) or Manufacturer’s Certificate of Origin (MCO) states that the vehicle is not for highway use. Off-road vehicle does not include a farm vehicle as defined in SDCL § 32-3-2.4. (Definition provided by SDCL § 32-20-1(4)). 

            UTILITY: means any provider of electric, gas, water, sewer, pipeline, or telecommunications service. 

            NORMAL AGRICULTURAL OPERATION: means operation of an off-road vehicle by a person engaged in a reasonably necessary agricultural related activity. 

            74.31   REGULATIONS

            A.         PROHIBITION

            Off-road vehicles shall not be operated in the City limits of the City of Garretson unless licensed to be used on a public highway pursuant to SDCL § 32-20-13 and provided that such vehicle operated by a licensed operator, and only on surfaces maintained as a roadway or alley.

            B.         EXCEPTIONS

            This Ordinance does not prohibit off-road vehicles from being operated off the paved portion of streets or highways within the City limits of Garretson:

            1. While on private property with the owner’s permission;

            2. While engaged in normal agricultural operations; or 

            3. While engaged in official maintenance activities for the City of Garretson or any utility company. 

            C.         SIGNAGE 

            The Public Works Director or his designee is responsible for posting and maintaining regulatory signs giving notice to the public or any restriction authorized by this Ordinance. Each regulatory sign shall be constructed according to the Manual on Uniform Traffic Control Devices and be posted in such a manner as to indicate to the public the nature and location of the restriction. 

74.99 PENALTY

            In addition to any other penalty authorized by State law or City ordinance, each violation of this Ordinance subjects the individual to a fine of two hundred ($200.00) dollars and/or imprisonment for a period not to exceed thirty (30) days.

            All ordinances and parts of ordinances in conflict with this ordinance are herby repealed. This ordinance shall be in full force and effects from and after its approval, adoption and publication as provided by law.

ORDINANCE NO 705

            AN ORDINANCE TO AMEND TITLE 5 PUBLIC WORKS: CHAPTER 50.29 DELIQUENT CHARGES

            BE IT ORDAINED BY THE CITY OF GARRETSON that the procedure for collection of delinquent utility bills be amended so that TITLE 5: PUBLIC WORKS CHAPTER 50.29, of the Municipal Code of the City of Garretson is amended to read as follows:

            50.29 DELIQUENT BILLS: 

            Billing is due upon receipt or by the 20th day of business of the current month. A utility bill shall be delinquent if payment is not received by the Utility Billing Clerk or the official city depository by the close of business on the 20th day of each month. If the 20th  day of the month falls on a weekend or another day in which the City office or official city depository is closed, said utility bill shall be considered delinquent if payment is not received by the close of business the following day said locations are open for business. If a utility bill is considered delinquent as herein set forth, a penalty shall apply as adopted by Resolution of the City Council which shall be on file in the office of the City Finance Officer.

            In addition to the penalties imposed above, the City Finance Officer, Utility Billing Clerk, and/or the Public Works Director may take the following action with regard to delinquent utility bills:

            A.         If payment is not received by the Utility Billing Clerk or the official city depository for two consecutive months before the close of business on the 25th day of the month following the initial delinquent utility bill, or close of business on the next regular business day for the City office or official city depository, the said utilities will be due for disconnection the following business day.

            B.         The City may, in addition to any payments and penalties to be paid by the consumer or owner of the property, require that a deposit of sufficient amount be forwarded to the City through the City Finance Office or official city depository to assure future payment of utility bills. Any reinstatement of services may require that both a deposit, as determined by the City Council, and a standard connection fee or service fee will be paid prior to any reinstatement of utility services.

            C.         If payment of all utilities is not made by the consumer or the owner, if such person be a different person than the consumer, then the Public Works Director shall terminate water service to the property before noon or as soon thereafter, but such action shall not relieve the consumer or owner of the property of the duty to pay any delinquent amounts and penalties owing.

            D.         If the consumer or the owner is served with a personal disconnection notice three times within a calendar year, they will be assessed an additional service fee on each personal notification thereafter.

            E.         In accordance with SDCL 34A-6-29 the City of Garretson may certify delinquent balance on past due utility bills not paid prior to September 30th plus interest, to the County Treasurer to be collected as assessments and will be collected by the County Treasurer in the following year as a condition precedent to the payments of the real property tax on the lot or parcel with respect to which the charge was made.

ORDINANCE NO 706

            AN ORDINANCE OF THE CITY OF GARRETSON, SOUTH DAKOTA, ESTABLISHING RURAL SERVICE DISTRICT AND URBAN SERVICE DISTRICT WITHIN THE CORPORATE LIMITS OF THE CITY OF GARRETSON.

            BE IT ORDAINED BE THE CITY OF GARRETSON that the following regulations are adopted pertaining to the establishment of rural service district and urban service district within the corporate limits of the City of Garretson:

            Section 1. Intent. Under the authority of SDCL Chap. 9-2lA, the City of Garretson intends to classify the property within the corporate limits of the City of Garretson be classified as urban and rural for purposes of ad valorem property taxation pursuant to the provisions of SDCL Chap. 9-21A.

            Section 2. Definition of Terms. Terms as used in this Ordinance shall be given the meanings as listed in SDCL § 9-21A-2.

            Section 3. Establishment of Urban Service District and Rural Service District. The City of Garretson divides the area within and abutting to its corporate limits into an urban service district and a rural service district, constituting separate taxing districts for the urban and rural property classified for such purposes by this Ordinance and for purposes of all the municipal ad valorem property taxes, except for those levied for the payment of bonds. Lands outside the corporate limits of the City of Garretson are designated for purposes of possible future annexation, handled under Section 4 below.

            Section 4. Rural Service District. The rural service district shall include only such platted or unplatted lands as in the judgment of the City of Garretson are rural in character, are used or usable for agriculture, and are not developed for commercial, industrial or urban residential purposes, and for these reasons are not benefited to the same degree as other lands by municipal services financed by general taxation. The rural service district may include lands which are not contiguous to one another. Lands outside the corporate limits of the City of Garretson may be designated as rural service district, and if annexed, shall be included within the rural service district.

            Section 5. Urban Service District. The urban service district shall include all lands within the boundaries of the City of Garretson which are not included in the rural service district.

            Section 6. Limitation on Tax Levy and Assessed Value of Rural Service District Lands. The tax levy and assessed value on the rural service district lands shall not exceed the average tax levy and average assessed value on unannexed agricultural land in adjoining townships in the county as long as the annexed agricultural land remains rural property as defined by SDCL § 9-2 l A-2.

            Section 7. Transfer of Rural Service District Lands to Urban Service District. Whenever any parcel of land located in the rural service district is platted, in whole or in part, and whenever application is made for a permit for the construction of a commercial, industrial, or urban residential development or improvement to be situated on such parcel or any part thereof, the board or officer approving such plat or building permit shall report it to the City of Garretson, which shall then take such necessary steps needed to transfer such parcel from the rural service district to the urban service district.

            Section 8. Allocation and Spread of Levies. Taxes levied for payment of bonds shall continue to be spread upon all taxable property within the corporate limits of the City of Garretson in proportion to the assessed valuation thereof. The remaining amount of the taxes levied each year shall be allocated by the county auditor to the urban service district and the rural service district in amounts proportionate to the current benefit ratio times the current benefit between the full and true values of all taxable property within the urban service district and all taxable property within the rural service district. Within each district, the amount so allocated shall be spread upon all taxable property in proportion to the assessed valuation thereof.

            Section 9. Certification of Tax Levy to County Auditor. The amount of taxes levied each year shall be certified to the county auditor.

            Section 10. Filing Ordinance with County Auditor. A certified copy of this ordinance and any amendment adopted or entered in connection therewith will be filed with the county auditory before it becomes effective.

•          Fire Department – New Building Site – T. Heitkamp presented proposed site for new fire hall and what next steps would be so they are able to begin building/fundraising. Council discussed having city attorney put together a purchase agreement with property description provided by Fire Department with the department providing a more specific description at a later date. Fire Department advised they would have property surveyed and come back with legal description once purchase agreement is provided. J. Doane requested plan for drainage in proposed area. Council member Bonte advised Fire Department must comply with city design standards and would be responsible for lessoning potential drainage issues. Council member Bonte motioned to proceed with a purchase agreement completed by city attorney and allowing Mayor Brown to sign when prepared.             At 7:30 p.m., the Board convened in the Library at the Garretson School District for a special board meeting. All votes are unanimous, unless specifically noted in the minutes. 

            President Mendoza led the Pledge of Allegiance and welcomed guests and visitors.

            President Mendoza called for any additions or corrections to the Board agenda. There were no additions or corrections presented.

            Action 25-025: Motion by Nordstrom, second by Compton, to approve the agenda as presented. Motion carried.

            Action 25-026: Motion by Clark, second by VanDeBerg, to appoint Attorney Gerry Kaufman Hearing Officer and Legal Counsel to the Board. Motion carried.

            Open floor to comments: Swenson commented she didn’t think there was enough kids in town to host a Christmas party for the kids of town.

            2.         Humane Society—received a bill for 2 different calls—Williams made a motion to pay bill, 2nd by Sutton-all ayes- motion approved.

            3.         Culvert 2nd and Zeliff Ave—Larry started working on it.

            4.         Liquor License- a bar in Sioux Falls was wanting to buy one of Sherman’s extra license—nothing came of it.

            5.         Curb, gutter and sidewalk project—for lack of support the project has stopped, can reapply next year if we want.

            6.         Next month meeting—next month we will have the monthly meeting on Monday night at 7:30pm, 2024 because of election being held on Tuesday

            Williams made a motion to adjourn, 2nd by Sutton—all ayes. Next regular meeting will be November 4, 2024 @ 7:30pm.

State official says employee error led to 273 non-US citizens on voter rolls

Department blamed for mistake pushes back, says it ‘does not register voters or determine eligibility’

The South Dakota Secretary of State’s Office is blaming the state Department of Public Safety for errors that allowed 273 non-U.S. citizens to register to vote, and the department is pushing back.

Rachel Soulek, director of the Division of Elections in the Secretary of State’s Office, placed blame on the department in her response to South Dakota Searchlight questions about the situation.

“These non U.S. citizens had marked ‘no’ to the citizenship question on their driver’s license application but were incorrectly processed as U.S. citizens due to human error by the Department of Public Safety,” Soulek wrote.

Noncitizens can obtain a driver’s license or state ID if they are lawful permanent residents or have temporary legal status. There’s a part of the driver’s license form that allows an applicant to register to vote. That part says voters must be citizens. 

Searchlight shared Soulek’s statement with the Department of Public Safety on Thursday. The department responded with a statement from Secretary Robert Perry.

“The Department of Public Safety does not register voters or determine eligibility,” Perry’s statement said. “It submits driver license applicant information to the Secretary of State’s Office to review for voter registration purposes in accordance with federal law.”

State election offices such as the Secretary of State’s Office are responsible for reviewing submitted registration forms, according to the Bipartisan Policy Institute. Verification can involve cross-referencing databases, such as the Social Security Administration or state records, to confirm the applicant’s eligibility.

According to the Brennan Center for Justice, while noncitizen voting is illegal in federal elections, mistakes can occur during the registration process. They say such mistakes are typically accidental and not driven by malicious intent.

Soulek said only one of the 273 noncitizens had ever cast a ballot. That was during the 2016 general election.

Searchlight sought the added information after the Department of Public Safety issued a news release Monday announcing it had worked with the Secretary of State’s Office and the state Bureau of Information and Telecommunications to purge the noncitizens from voter rolls. 

“This discovery was part of a review to ensure the integrity of South Dakota’s elections and safeguard against improper voter registration,” the news release said.

The department said nothing further in the news release about how the noncitizens were discovered on the voter rolls, how they became registered in the first place, what counties they registered in, or whether any of the noncitizens had ever cast a ballot.

Department spokesman Brad Reiners, who shared the news release with South Dakota media, initially responded Monday to Searchlight questions about the news release by saying “the press release speaks for itself” and referring questions to the Secretary of State’s Office. 

The American Civil Liberties Union of South Dakota alleged Tuesday that the state violated the National Voter Registration Act. The act prohibits voter list maintenance within 90 days of a federal election unless it’s based on individualized information or investigations, the ACLU said. 

Samantha Chapman, ACLU of South Dakota’s advocacy manager, said the state can make individualized inquiries into specific voters with evidence to support its claims that an individual is not legally eligible to vote, but “it cannot enact blanket purges based on potentially inaccurate databases this close to the election.” 

“The risk of disenfranchising eligible voters at this late stage is simply too high when voters have a mere 13 days before the voter registration deadline,” Chapman said.

Ward 2 Councilman dies post meeting

            Ward 2 councilmember Tom Godbey passed away unexpectedly late Monday evening/early Tuesday morning, despite looking to be in good health during Monday evening's meeting. He was on the council for many years, at one point running for Mayor. A long-time figure in city politics, no one had any indication that this October 7 city council meeting would be his last.

            In a statement to the Gazette, Mayor Bruce Brown said, "The city of Garretson would like to extend their condolences to the Godbey family with the sudden loss of Council Member Tom Godbey. His love for the City of Garretson will be greatly missed. Tom's sincere dedication to the city parks will forever be unmatched in his gift of trees and shelter he built by hand."

            Godbey had a zest for ensuring the health of the city parks, sidewalk accessibility, and that the city was running as efficiently as possible. Despite a lifelong speech disability, he was not afraid to speak his mind, even if it was not a majority opinion.

            He was a longtime Garretson School bus driver who prided himself on delivering students safely to and from school and sporting events. In a statement, the Garretson School District said, "Tom took great pride in his role, not only delivering the kids to and from school safely, but also transporting our student athletes safely to and from the destination of their contests. He oftentimes would wear a tie on activity trips as a sign of how important those events were to him.”

            "Tom was not necessarily known as a man who loved change. That being said, he accepted the change to an electric bus without argument, and after driving the electric bus on the route, he reported that one of the best parts about it was that the bus was quiet enough that he could hear the kids well enough to talk to them and get to know them better. He was known to have said that driving the school bus was the most meaningful job he'd ever had.

            "Our thoughts and prayers go out to Karla, Derrick, Meghan, Danielle and the rest of the Godbey family. Tom made a difference for our kids. He will be missed by all of us."

Off-Road Vehicle Ban

            The Garretson City Council is likely to move forward with an off-road vehicle ban, but not in the format it was in before.

            At the October regular meeting held this past Monday, a new version of the ordinance banning off-road vehicles was put through another first reading. In this version, language clarified that the vehicles were not going to be banned from Garretson city limits entirely, nor from the parks entirely.

            The initial proposal to create an ordinance, which was brought forward in August, had requested that any off-road vehicle not be allowed to be on city property, except those vehicles that were licensed and equipped for road use. The reason for this was due to dirt bikes and ATVs that had torn up grass and roadways in Split Rock Park and Devil's Gulch by visitors and residents, and there was no legal recourse for the city to recoup the cost of repairs. There had also been an incident with off-road vehicles on private property doing the same damage without permission.

            In a first reading at September's meeting, the ban within areas considered city property remained unless it was on a roadway, but the vague language was a cause for concern, leading residents to believe their road-worthy UTVs would not be allowed to drive on the roadways inside the parks.
