 GRANT AGREEMENT

Daniel Haggar, State's Attorney, presented a request for authorization for the Chair to sign the Office of Violence Against Women Training Technical Assistant Sub-Recipient Grant Agreement with the South Dakota Office of Attorney General's Department of Criminal Investigation. The Board of County Commissioners had authorized the State's Attorney's Office to apply for a Department of Justice Intimate Partner Violence Office of Violence Against Women Training Technical Assistance Grant. The State's Attorney's Office and the Sheriff's Office were successful in the grant application and received a total of $375,000 in grants funds, with the State's Attorney's Office receiving grant funds of $235,909.51 and the Sheriff's Office received grant funds of $139,090.49. In a four-year time span, intimate partner violence/domestic violence criminal cases in Minnehaha County have increased by approximately 35%. Due to the increase in these types of cases, the Minnehaha County State's Attorney's Office has become involved in a state-wide grant project to help ensure funding to combat the prevalence of intimate partner violence/domestic violence cases. An Improve the Criminal Justice Response grant has allowed Minnehaha County to dedicate a specialized prosecutor to prosecute these cases and help ensure a more successful outcome. In addition, the prosecutor will work with the Minnehaha County Sheriff's Office and other law enforcement agencies to form connections and teams that will work towards holding defendants accountable while also focusing on a victim-centered prosecution. The Office of Violence Against Women Training Technical Assistance Grant will help support these ongoing connections, which includes training for law enforcement, advocates and other involved partners. MOTION by Beninga, seconded by Bleyenberg, to Authorize the Chair to Sign the Office of Violence Against Women Training Technical Assistance Sub-Recipient Grant Agreement with the South Dakota Office of the Attorney General/DCI. By roll call vote: 5 ayes.

LEASE AGREEMENT

Joe Bosman, Captain, presented a request for the Chair to sign the lease agreement between Minnehaha County and Townsquare Media for communications equipment. As part of the first responder radio communications project currently in progress under the Sheriff's Office, the five additional tower sites previously outlined in this project will each require an agreement to be signed between Minnehaha County and the respective site owner. The proposed agreement with Townsquare Media allows Minnehaha County the ability to utilize their existing equipment shelter, communications tower and install necessary equipment and infrastructure for the digital radio system to function. The proposed agreement is for a period of five (5) years, with a built-in extension for an additional five (5) years on the same terms and conditions. The tower and equipment shelter utilities, and maintenance will be the responsibility of Townsquare Media. Minnehaha County would own the radio equipment inside the building and the antennas on the tower. The monthly rent for the shelter and tower usage is $500 per month with costs being covered through the Emergency Management budget. MOTION by Kippley, seconded by Bender, to Authorize the Chair to Sign a Lease Agreement for the KKLS Radio Tower Site. By roll call vote: 5 ayes.

BID RESULTS

Jacob Maras, Interim Highway Superintendent, reported on the bid opening for Project MC 23-06 Structure 50-180-134 Replacement held on November 13, 2024. The following bids were received: BX Civil & Construction with a total bid of $825,509.65; Black Top Paving with a total bid of $867,532.57; Nolz Dragline and Construction with a total bid of $913,871.74; Timmons Construction with a total bid of $933,837.12; Kea Construction with a total bid of $949,181.06; Katzer Concrete with a total bid of $1,004,927.44; and Graves Construction, Inc. with a total bid of $1.015,510.05. MOTION by Bender, seconded by Beninga, to Approve Bid Results and Award Recommendation for Project MC23-06 Structure 50-180-134 Replacement and Authorize Chair to Sign an Agreement with BX Civil & Construction Pending SDDOT Concurrence. By roll call vote: 5 ayes.

RIGHT OF WAY PURCHASE AGREEMENT

Jacob Maras, Interim Highway Superintendent, presented a right-of-way purchase agreement between Edward and Deanna Nolz and Minnehaha County. The Highway Department has opened bids for the replacement of Structure 50-180-134 on County Highway 133 over an unnamed tributary of the Big Sioux River. Additional property is required for the construction and maintenance of the bridge on both the east and west side. Minnehaha County also strives to acquire 50' of ROW on each side of road, so additional ROW was purchased to meet that standard. MOTION by Beninga, seconded by Bleyenberg, to Authorize the Chair to Sign a Right-of-Way Purchase Agreement with Edward and Deanna Nolz, for Structure 50-180-134 for the Property Legally Described as Lot H-2 Tract 2 of Otterby's Addition in the Northeast Quarter (NE 1/4) of Section 12, Township 102 North, Range 50 West of the 5th P.M., Minnehaha County, South Dakota, a Total of 0.11 Acres in the Amount of $1,430, and for the Property Legally Described as Lot H-1 Tract 3 of Otterby's Addition in the West Half of the Northwest Quarter (W1/2NW1/4) of Section 7, Township 102 North, Range 49 West of the 5th P.M., Minnehaha County, South Dakota, a Total of 0.81 Acres in the Amount of $10,530. By roll call vote: 5 ayes.

LEASE AGREEMENTS

  Bill Hoskins, Museum Director, gave a briefing on the 2025 Lease with the Sioux Valley Genealogical Society. Under the terms of the agreement, the Sioux Valley Genealogical Society will lease approximately 600 square feet of office space on the second floor of the Old Courthouse Museum until December 31, 2025. There is no charge for the lease space. The County pays for the light, heat, and custodial services. The Sioux Valley Genealogical Society pays for their phone and comprehensive liability insurance. MOTION by Bleyenberg, seconded by Kippley, to Authorize the Chair to Sign the Annual Lease Agreement with the Sioux Valley Genealogical Society. By roll call vote: 5 ayes.

SPECIAL PERSONNEL ACTION

Carey Deaver, Human Resources Director, gave a briefing on elected officials' salary history and presented a resolution for consideration for establishing the 2025 Elected Department Head Annual Salaries. South Dakota Codified Law provides the statutory minimum annual salaries for County Treasurer, Auditor, Register of Deeds, State's Attorney, and Sheriff. An elected official salary history, a comparison of department head salaries, and an elected official market summary and assistant department head salary were provided. The proposed resolution will set the current elected officials' annual salary, and the minimum salaries for newly elected officials. MOTION by Bender, seconded by Beninga, to Adopt Resolution MC 24-22 Establishing 2025 Elected Department Head Annual Salaries. By roll call vote: 5 ayes.
RESOLUTION MC 24-22

ESTABLISHMENT OF COUNTY ELECTED DEPARTMENT HEAD ANNUAL SALARIES

WHEREAS, the Minnehaha County Commission is dedicated to attracting citizens of the highest quality to public service by establishing proper salaries for elected department heads and basing those salaries on realistic standards and according to the duties of their respective offices; and 

WHEREAS, South Dakota Codified Law provides for certain statutory minimum annual salaries for the State’s Attorney, Sheriff, Treasurer, Auditor, and Register of Deeds (“County Officers”), absent a resolution from the County Commission establishing a different annual salary for each official, pursuant to SDCL 7-7-9.1, SDCL 7-7-12, and SDCL 7-12-15; and 

WHEREAS, it is the sense of the County Commission that these statutory minimum annual salaries are inadequate compensation for the duties discharged by these officials;

NOW THEREFORE BE IT RESOLVED, by the Minnehaha County Board of Commissioners:

1. The minimum annual base salaries for County Officers, including individuals duly elected as a County Officer but whose initial term of office has not yet commenced prior to the date of this Resolution and including individuals appointed to fill a vacancy in a County Office, are set as follows:

State’s Attorney       $130,000.00

Sheriff          $108,680.00

Auditor         $89,232.00

Treasurer      $89,232.00

Register of Deeds  $89,232.00

2. Effective December 21, 2024, County Officers whose term of office began prior to the date of this Resolution shall receive pay rates based on salaries as follows:  

State’s Attorney       $186,825.60

Sheriff          $196,164.80

Auditor         $101,212.80

Treasurer      $118,144.00

Register of Deeds  $101,212.80

These rates will be calculated and paid in the same manner as other exempt from overtime positions at Minnehaha County to include weeks in which an elected department head begins and ends employment.

ALCOHOL LICENSE

DECEDENT TRANSPORT AGREEMENT

Tom Greco, Commission Administrative Officer, was present to request authorization for the Chair to Sign Decedent Transport Agreement between Minnehaha County and Dakota Embalming and Transport, Inc. The current Decedent Transport professional services agreement will terminate on November 29, 2024, by way of notice from the current contractor. The County received notice on September 30 and steps have been taken to find a contractor able and willing to take this professional services contract. Dakota Embalming and Transports, Inc., has offered a detailed proposal and pricing structure that will satisfy the requirements to render and perform such services. The costs associated with the proposed agreement are: removal and transport of decedent from a controlled facility (including without limitation: Medical Facility, Hospitals, Hospice Houses, Nursing Home Facilities, etc.) with one (1) employee to the Coroner's Office: $450.00; removal and transport of decedent from Non-controlled locations (any location other than controlled facility as defined above) with two (2) employees to Coroner's Office as follows: all non-controlled locations inside Sioux Falls City limits (Minnehaha County): $950.00 and all other locations outside Sioux Falls City limits (Minnehaha County): $1050.00.  In addition, for any removal and transport of a decedent requiring additional staffing (i.e. obese decedent or difficult removal locations for which additional staff is required) additional fees as follows: Three (3) employees: $150.00 and Four (4) employees $100.00; removal any removal and transport for hazmat protocols must be followed (including but limited to decedents in advanced states of decomposition) an additional Hazmat Removal Fee: $300.00. Dakota Embalming and Transport also proposes a monthly 24-hour on-call service fee to be billed monthly at $3,000.00. MOTION by Bleyenberg, seconded by Beninga, to Authorize the Chair to Sign Decedent Transport Agreement between Minnehaha County and Dakota Embalming and Transport, Inc., for a One-Year Term Beginning November 30, 2024. By roll call vote: 5 ayes.

By roll call vote: 4 ayes. Jacob Maras, Assistant Highway Superintendent, thanked the Commission for the ‌opportunity to serve as the Interim Highway Superintendent.

ALCOHOL LICENSE

Kym Christiansen, Commission Recorder, presented the liquor and wine license renewal applications for the 2025 licensing year. The applications were reviewed by the State's Attorney's Office, the Sheriff's Office, and the Planning & Zoning Department. One concern was raised by the Planning Department regarding the Alibi since the establishment stated that the license is not in active use and is currently closed for remodeling. Mrs. HV's third grade class had a great time putting together some turkey recipes for you to use this Thanksgiving holiday! We hope you enjoy, as these all sound wonderfully delicious.

Norah's Turkey - Time: 1 hour; Serve: 5

Ingredients: salt, cheese, love, ketchup, ranch, meat, alives, BBQ sauce, oil, stuffing, pepper, Turkey

Instructions: First pre-heat oven to 150°F. After wait 10 min. for the oven to pre-heat. after that put the turkey in the oven for 1 hour. Take the turkey awt of the oven and put the Ingredients with it. - Norah H.

Olivia's Fabulous Turkey - Time: 5 1/2 hrs.; Serve: 7 people

Ingredients: Peper, Salt, Chilly peper, Orange juice, Oven, Olive oil, Butter, Brown sugar, vinigar, water, A LOT OF MILK, Sugar

Instructions: First, pre-heat oven to 450°F. Next, put turkey in oven. Then once it's done, carve turkey into 50 pieces. Also, put all of the ingredients into a seprate bowl. Legion Update for November

The Henry G. Fix Post 23 meeting opened on Thursday, November 7th at 8:00 pm.  The meeting was opened by Commander Jon Schmidt with a salute to the Colors, POW/MIA observance, the Pledge of Allegiance, and Preamble to the American Legion Constitution.  Chaplain Lampe offered the prayer.  22 members were present.  

The minutes of the previous meeting were presented and approved. The finance and social reports were approved.  Bills were approved for payment.  Rob Meyer highlighted the upcoming Hometown Christmas activities.  There will be a Legion breakfast, vendor fair, the Army/Navy game, and Fire Department Chili Cookoff, all at Post 23!   

Service Officer Nancy Grandy reported that sympathy cards were sent to Reid and Ruth Christopherson, and to Nathan Christopherson.  A get-well card was sent to Lois Wiese.  A Get-well card will be sent to Don Wagner.  Nancy will check in to see how Doris Nedved is doing.  

The membership report was given by Nancy Grandy.  She reported that our 2025 goal is 201 members.  Our November goal is 65% (131 members).  We currently have a total of 144 renewed members (72%) at this point. 

Bob Bennett presented information on Veterans sharing meals with students at the school.  The Veterans Day program at the school with be on Veterans Day at 2:15 pm.  The Post 23 dinner and program will be that evening with social hour at 6 pm and meal at 7 pm.  

The Wiese family donated $1300 to the Legion scholarship fund.  A $1000 scholarship will be awarded this year in Owen’s name.  With current funding and interest rates we will be able to increase future scholarships to $750.  

Paul Evenson reported that the Color Guard performed military rites for Army Vietnam Veteran Keith Jones on October 17th.  They also gave honors at the Sioux Falls VA hospital on November 2nd.  There will be a Legislative Roundup at the Sioux Falls DAV on November 20th.  One of the support pieces is Legion support for full GI benefits to National Guard and Reserve service members.

Post Commander Schmidt attended the District 7 fall meeting and presented our donation to the Department Commanders Scouting Camping Scholarship.

Our next Post meeting will be Thursday, December 5th with the meal at 7 pm and meeting at 8 pm.  The next Post breakfast will be December 14th for the Hometown Christmas from 9 am to 1 pm with French toast on the menu.  The next County meeting will be held at our Post on February 25th.  The next District meeting will be held March 30th in Garretson.  The Department Mid-Winter Conference will be in Oacoma February 14th through the 16th.  

A motion was made and approved to donate the net proceeds of tonight’s meal to the Auxiliary Unit 23 Scholarship Fund.  Josh Lampe asked for use of the building for a new K9 Search and Rescue team.  A motion passed to support this volunteer organization.  Commander Schmidt shared a thank you note from the Dale Schmiesing family.   

The monthly raffle drawing took place.  There were 5 drawings for November.  Winners were:  Mark Homandberg, Teresa Kramer, Caleb Frerk, and Kyle Evenson.  Each will receive $150!  A special $500 drawing took place with Tyler Engebretson as the lucky winner! 

Commander Jon Schmidt closed the meeting with the usual ceremony at 8:43 pm.

Maras takes helm as new interim highway superintendent for Minnehaha County

SIOUX FALLS – Assistant Highway Superintendent Jacob Maras was appointed Interim Highway Superintendent at the Tuesday, Nov. 19, Minnehaha County Commission meeting.

Minnehaha County Commissioners approved the appointment of Jacob Maras, the current Assistant Highway Superintendent, to be the Interim Superintendent and replace Steve Groen, who recently left to take a new job in Topeka Kansas.

He will be replacing Steve Groen, whose last day was Thursday, Nov. 21. Groen will be taking the job of Public Works Director in Topeka, Kan.

Although Groen said he has enjoyed working for Minnehaha County, his new position will allow him to be closer to family members in the Topeka area.

Maras will continue with his interim duties until a new highway superintendent is hired in the near future.

All members of the commission gave kudos to Groen for his work, and congratulated Maras on his appointment.

Commission Chairman Dean Karsky said, “(The highways department) has great employees, and the morale is high, so we are glad to keep this going.”

Lifescape helps region

Lifescape president Jessica Wells gave the foundation’s annual report to commissioners about what they do for the public.

According to their website, Lifescape helps children and adults from all over the region who have disability and medical rehabilitation needs.

Wells said, that for adults, they have people placed in five different residential homes just in the Sioux Falls-area, and they are planning to build a sixth.

Beyond that, they provide help for 433 more with adult daycare services, employment training and other community support.

For children, Lifescape currently has 18 beds in their specialty hospital, a 60-bed children’s residential facility, and they serve 134 students in their specialty school.

Wells said that Lifescape also works with 80 different school districts to help students.

And over 150 of their clients are in the process of working to complete job internship training.

In a chart, she showed that Lifescape works with almost 5,000 people: 4,109 from South Dakota, 291 from Iowa, 188 from Minnesota, 78 from Wyoming, 36 from Nebraska, 21 from North Dakota and 5 from Montana.

And even with those numbers, Wells pointed out that there is still a waiting list for Lifescape’s services.

She also discussed that their program has outgrown their current facility on 26th St. in Sioux Falls, which was built as Crippled Children’s Hospital in 1948, and last April they broke ground on a new building on Career Ave. in northwest Sioux Falls. 

So far they have raised $95 million toward the $98.3 million project they plan to have completed by the fall of 2026.

While more people will be able to be housed and attend classes in the new building, it will also include a regular pool, therapy pool, gym, and indoor and outdoor playgrounds.

Commissioner Gerald Beninga summed up the importance of Lifescape when he said, “You guys are a fabulous organization. I’ve been through that facility multiple times, and what you do for the whole region is incredible.”

He added that he felt it was impossible to walk through the facility and not make some kind of emotional connection.

The next meeting of the county commission will be at 9 a.m. Tuesday, Dec. 3, in the third-floor meeting room of the Minnehaha County Administration Building at 6th and Minnesota in Sioux Falls.

As I write this, we haven't had any white stuff yet! Fall has been pretty mild and wonderful. The fourth street improvement project has been going well and by the time you read this, it should be close to being done. Thank-you to everyone who worked so hard to get it done and for the patience of those of you who live on 4th St.

December is fun in Garretson! A great event, Hometown Christmas, is just around the corner. (Dec 14th) The Commercial Club has been planning this year’s event since spring and the calendar is full of events. I don't have room to cover every single one, but you can find the complete schedule on VisitGarretsonSD.com. Paper copies are also available from local merchants and a direct mail piece is also planned. 

The downtown merchants are actively involved and will be offering specials as well as fun events. Be sure to check out the Treasure Chest, Palisades Art Gallery and the Public Library. There are many things going on at the Legion, starting off with breakfast at 9 AM, at the same time there will be a vendor fair featuring lots of really cool stuff. Later in the day, the Legion will be the site for the silent auction, a bake sale, Army/Navy Game, followed by a Chili Contest and Bingo benefiting the Garretson Fire Department.  The Museum will be open from 10-6 with coffee, hot cider and popcorn, as well as commemorative ornaments  celebrating 40 years of service by the Garretson Area Historic Society. At 1:00 Santa arrives at the Treasure Chest. 

The annual Parade of Lights starts at 6 PM. Dress warm and enjoy the show. Hope to see everyone there supporting this great town.

As we get into the snow season it is very important that you follow Snow Emergency information and rules. Our city crew works very hard to get and keep the streets clear, but they can't do it without your cooperation. Many times, they start at 4 AM after a 2 or more inch snow and work pretty much till it is cleaned up. 

Notice of a snow emergency will be posted on the City of Garretson website and app (available through your phone app store). You are going to want to download the app as there is a lot of valuable info at your fingertips on it. A Snow Emergency will also be broadcast on local news stations. But just to review the rules:

1. A snow emergency will be declared when we receive over 2 inches of snow. (You need to remember this if you don't watch TV or don't have the app.)

2. During a snow emergency NO vehicles will be parked on the city streets until they are cleared of snow. Parallel parking only down town on Main Street. If you violate this, your car will be ticketed and towed. Please don't do it, it is expensive and time consuming for everyone.

3. Sidewalks must be cleared of snow and ice within 24 hours  of cessation of snow. This is a safety issue  for people walking and kids going to school. Please get it done! There are consequences for failure to do this.

4. Do not throw snow into the street after it has been plowed. This applies to snow blowing as well as shoveling. I know it is frustrating to have our plows come by and block your just-cleared driveway. You can throw snow into the street before it is plowed, but not after. This helps the crews as well as your neighbors.

5. If you want the PO to deliver your mail the mailbox must be dug out to allow them to pull up to it.

6. It is also a very good idea to scoop out your gas meter, as well as any fire hydrants near your house. Again, these are safety concerns for you and your family.

  If you have neighbors who are not able to scoop, do it for them. You're already dressed and warmed up,  so help some others out. Pay it forward.
