An Open Letter to the Editor:

We are four former South Dakota State Librarians. We strongly urge the South Dakota State Legislature to vote NO on the proposed changes (HB 1041) to the South Dakota State Library and the corresponding state statutes. The current staff of 21.5 employees are some of the most efficient civil servants in state government serving as a resource for over 500 libraries. The South Dakota State Library is one of the smallest state libraries among their fifty state counterparts. Yet, they are highly regarded and appreciated by the communities they serve. 

In 2006 a thorough review by an out-of-state expert/consultant was conducted. This led the way for modernization, down-sizing and much greater efficiencies. (See 2006 Bushing Report)  At that time, staffing was at 37, then reduced to 27  which was again reduced a decade later to the current 21.5 staff  to pay for a new, less costly and more technologically advanced “overlay”. This new system which was named South Dakota Share-IT allowed the State Library to link all participating libraries with no cost to the local school or public library. The end result is that patrons can discover what each library has for their physical holdings. For example, a search by a patron in Lemmon Public can see what Siouxland Library has and a student at Aberdeen High School can locate a specific book title which SDSU has. This has resulted in over 71,500 inter-Library loans between and among South Dakota libraries in 2023. What tremendous use of resources and savings for local communities! 

The state’s universities and a few larger public libraries are also members of the international OCLC network. However, without the State Library’s connecting software and their librarians who manage it, most of the state will go dark. The information isolation will be devastating to local schools and communities, particularly rural areas. Without access to magazine articles through subject databases and access to books held by hundreds of linked South Dakota libraries, individual research and inter-library loan will be severely curtailed.

In short, the proposed drastic reduction of personnel and budget cuts would severely limit the State Library’s capacity to support k-12 schools, homeschoolers, public and academic libraries. Additionally, the economic impact overtime would be crippling, again most especially to rural schools and communities. This ill-advised legislation will NOT save tax-payers’ money. In fact, it will most likely have the opposite effect, costing tax-payers more money but with limited access to fewer resources, trainings and services.

We strongly urge South Dakota lawmakers to reject HB1041. Restore full funding (including accepting annual federal funds) to support the amazing work of the State Library. Please contact your local libraries, school boards and community leaders. The State Library is an efficient, cost-effective, trusted and valuable resource for all South Dakotans.

Lab-grown meat labeling, fees for serving legal papers, stenography rule change signed into law

South Dakota Gov. Larry Rhoden has signed bills into law to let county sheriffs charge a fee for serving legal papers, open the records of former governors five years faster, and require lab-grown meat to be labeled as such.

Also among the 14 bills Rhoden signed Monday: A repeal of the right of parties in some court cases to demand a court reporter if a judge feels a transcribable audio recording will do.

Under the lab-grown meat labeling law, which will take effect July 1, packages must “clearly state in a prominent and conspicuous manner” that there’s cell-cultured or lab-grown meat inside.

The meat is produced from sample cells that are fed sugars, water, proteins and vitamins. The state Senate is poised to ponder a more severe approach to the product, which some ranchers see as a threat to their livelihood. 

That bill, sponsored by Dupree-area rancher and Republican Rep. Jana Hunt, would bar altogether the manufacture or sale of the products in South Dakota. It passed the state House of Representatives 42-26 on Thursday. 

The stenography bill sailed through both chambers with unanimous support. The state court system brought the bill in response to a court reporter shortage, noting that its courtroom recording systems capture audio that can be transcribed as needed.

The process service bill lets sheriffs charge a range of fees – including mileage – to recoup costs associated with things like serving warrants or serving a summons to appear; the records bill opens previously sealed records of a former South Dakota governor five years after they leave office. Current law seals those records for 10 years.

Lawmakers advance bill requiring SD schools to teach Native American history, culture

South Dakota public schools would be required to teach a specific set of Native American historical and cultural lessons if a bill unanimously endorsed by a legislative committee Tuesday in Pierre becomes law.

The bill would mandate the teaching of the Oceti Sakowin Essential Understandings. The phrase “Oceti Sakowin” refers to the Lakota, Dakota and Nakota people. The understandings are a set of standards and lessons adopted seven years ago by the South Dakota Board of Education Standards with input from tribal leaders, educators and elders.

Use of the understandings by public schools is optional. A survey conducted by the state Department of Education indicated use by 62% of teachers, but the survey was voluntary and hundreds of teachers did not respond.

Republican state Sen. Tamara Grove, who lives on the Lower Brule Reservation, proposed the bill and asked legislators to follow the lead of Sisseton Wahpeton Oyate Chairman J. Garret Renville. He has publicly called for a “reset” of state-tribal relations since the departure of former Gov. Kristi Noem, who was barred by tribal leaders from entering tribal land in the state.

“What I’m asking you to do today,” Grove said, “is to lean into the reset.”

Joe Graves, the state secretary of education and a Noem appointee, testified against the bill. He said portions of the understandings are already incorporated into the state’s social studies standards. He added that the state only mandates four curricular areas: math, science, social studies and English-language arts/reading. He said further mandates would “tighten up the school days, leaving schools with much less instructional flexibility.”

Members of the Senate Education Committee sided with Grove and other supporters, voting 7-0 to send the bill to the full Senate.

The proposal is one of several education mandates that lawmakers have considered this legislative session. The state House rejected a bill this week that would have required posting and teaching the Ten Commandments in schools, and also rejected a bill that would have required schools to post the state motto, “Under God the People Rule.”

Legislation restricting labor union activity passes SD committee

A bill proposing to strengthen South Dakota’s “right-to-work” laws — described by critics as anti-union laws — will head to the House floor, despite hesitancy among legislative committee members who endorsed the legislation Monday at the Capitol in Pierre.

Twenty-eight states, including South Dakota, have “right-to-work” laws stipulating that workers can’t be forced to join or pay dues to a labor union, according to the National Conference of State Legislatures.

House Bill 1166, introduced by Rapid City Republican Rep. Tony Randolph, would expand South Dakota’s “right-to-work” laws by requiring labor union representatives to get permission from an owner or employer to enter worksites before they collect dues, solicit membership or organize a strike. It also increases penalties for violating some “right-to-work” laws from a misdemeanor to a felony. 

Union representatives opposed the legislation, saying references to the penalized activity are too vague, as is the definition for who qualifies as an “employer” to grant permission for entering a worksite. They also said the bill violates federal law and would disrupt standardization for companies operating in several states.

“If we have union members on job sites, we represent them. We have a legal right and need to communicate with them,” said Kory Rawstern, representing the South Dakota State Federation of Labor.

The National Right to Work Committee and the South Dakota Association of Plumbing-Heating-Cooling Contractors spoke in support of the bill. Association Vice President Kristie Brunick said members are frustrated with union officials recruiting on private construction sites.

Rep. Steve Duffy, R-Rapid City, voted in favor of the bill, though he and other committee members were skeptical of the bill’s language because of concerns raised by opponents.

“I’m not a pro-union person, but the bill looks like a mess, to be honest with you,” Duffy said during the hearing. “I’m probably going to support it either way. But it does not look like it’s been done right.”

The bill passed with a 10-2 vote and heads to the House floor next.

Proposal to allow concealed pistols on college campuses advances in SD Legislature

A South Dakota Senate committee advanced a bill Monday at the Capitol in Pierre that would allow people to carry concealed pistols on technical college and public university campuses.

Policies in both systems currently prohibit guns and other dangerous weapons on campus. The bill only addresses concealed carry and does not include language saying open carry would be allowed.

Higher education officials and law enforcement authorities raised concerns during the committee hearing about improperly stored guns in dorms and increased risks for students.

“A student living in a communal area could leave their gun sitting on their nightstand, could leave it on a dining room table when they are not actively carrying it, and we wouldn’t be able to place any constraints, restrictions,” said Nathan Lukkes, executive director of the South Dakota Board of Regents, which oversees the state’s six public universities.

The legislation would not only force the Board of Regents and Board of Technical Education to allow the possession of concealed pistols and ammunition, but also stun guns, mace and pepper spray.

Sen. Mykala Voita, R-Bonesteel, is the bill’s primary sponsor. She said the measure aligns with South Dakota’s other gun laws and ensures students can defend themselves.

“Is the security guard going to walk with you to the parking lot?” Voita asked rhetorically. “Are they going to be with you in every building?”

The National Shooting Sports Foundation and National Rifle Association spoke in favor of the bill.

Jenna Severyn, representing the South Dakota Police Chiefs Association, spoke against the bill and said the association is concerned about young people controlling their impulses while carrying concealed firearms.

“This is about, can my brain think quicker than my trigger finger?” she said. “And studies have shown that youth, specifically in the age we are talking about today, don’t have that.”

The bill passed the Senate State Affairs Committee 7-2 and now heads to the full Senate.

Meanwhile, the House Commerce and Energy Committee unanimously endorsed separate firearms legislation Monday morning. That bill would prohibit credit card companies and financial institutions from requiring retail tracking codes specifically for gun and ammunition sales. It’s already passed the Senate and will go to the House next.

Legislative Update: From Rep Les Heinemann

On Sunday, February 2, I attended the walk for life at the state capital along with many other legislators and families. It was wonderful to have my twin granddaughters Rebecca and Rachel sing with our speaker of the house and fellow seatmate Jon Hanson for the program at the Capitol rotunda.

 It was an eventful week in Pierre, both in committee and on the House floor. In the House Health and Human Services Committee, access to effective medical care was at the forefront of everyone's mind. With healthcare providers being difficult to access, bills attempting to alleviate this issue have been brought before the committee.

House Bill 1071 was presented to the House Health and Human Services Committee on Tuesday. It sought to allow physician assistants greater freedom to practice privately. While there was agreement that healthcare is difficult to access in remote areas of South Dakota, the committee was split on the bill.

The committee did not question or deny the professionalism or skill of licensed physician assistants, but they did raise concerns about the types of procedures these assistants would be allowed to perform without supervision. The committee passed the bill onto the House floor with a 9-3 vote.

Following HB 1071 was House Bill 1098, which aimed to reimburse the cost of respite care services for caregivers of individuals with dementia and to declare an emergency. The committee heard heartfelt testimony and the stories of those affected by this terrible disease. In unanimous agreement, they passed the bill on to the Appropriations Committee for funding and approval.

In the House State Affairs Committee, voting security and campaign finance law have been relevant issues. Although every member agrees that South Dakota should have free and fair elections, they have differing opinions on how to conduct them. They are actively working toward a solution that ensures no voter is left out and are considering safeguards against fraudulent ballots. They have also passed bills aimed at closing loopholes in South Dakota’s campaign finance law.

On the House Floor, there have been several engaging debates. I introduced a motion calling for an Article V convention of states. I raised major concerns with Washington, D.C., emphasizing that the federal government has encroached on states' rights, greatly expanded the national debt, and that Congress has shrunk from its responsibility as lawmakers. While all members of the House agreed with the spirit of the bill, they disagreed with calling for an Article V convention. The motion was defeated with a vote of 38-29.

Some of our district constituents were out here for association get togethers, so it was good to connect with them. Also, we were able to tour the telemedicine available on ambulances which they said Flandreau has on their ambulance.

Q&A: Dusty Johnson talks Trump, tariffs and the Panama Canal

During a visit to the Black Hills Stock Show in Rapid City recently, the Republican weighed in on the top issue constituents want to talk about, why he sponsored a bill to buy back the Panama Canal, his thoughts on the presidential pardons of Capitol rioters and other issues.

Here, in his own words, are Johnson's answers, which have been edited for length.

Question: What are you hearing from your constituents in Rapid City today?

Answer: "It's still a lot about the border. I mean, really, in the last two years, that has been the dominant policy topic. People have seen how quickly things have changed. They saw that in the House. We passed the Laken Riley Act (that requires detainment of illegal immigrants who commit crimes) and then we got it signed into law by President (Donald) Trump. They have seen that border crossings are fallen by two-thirds in a relatively short span of time. So I think there's some optimism around the idea that we can actually solve some of these public policy problems that were, really, the referendum that the November election turned on."

Q: What are your top priorities in the current session of the U.S. House of Representatives?

A: "I'm a big believer in work requirements. We, of course, we need to have programs that help people out when they're in trouble, when they're down and out. If you're able-bodied, you should work. ... I would tell you, also, the Chinese Communist Party is also a much bigger threat than most Americans realize. And so my bill to prohibit the Chinese Communist Party from buying American farmland, that is a real crowd pleaser because I think everyone understands food security is national security. And there is no reason we should give an adversary control over our food supply. ... And then the border, of course."

Q: Are you concerned at all about immigration crackdowns affecting South Dakota agriculture or businesses?

A: "To the extent that there are South Dakota businesses who may be relying on the illegal labor, on labor that's not allowed to be here, they are. They are going to be impacted. Americans here illegally, understand they're here illegally. I've talked to a number of folks. I mean, every day I'm talking to people who were not born in America, and those people were here legally. Overwhelmingly, the sense I get from them is that they know they don't have anything to fear."

Q: Why did you sponsor the bill to allow the U.S. to take over control of the Panama Canal?

A: "I think the president should be given the flexibility to go have the conversation. I get it, a lot of folks on the left don't like Donald Trump. I do get a little frustrated at all of the pearl clutching, the idea that it's dangerous to even have a conversation. ... It seems like some on the left are more comfortable with Chinese Communist Party influence in the Panama region than they are with American influence. ... It is an asset that is uniquely important to our country. I don't know whether buying back the canal is possible. I don't know whether it's prudent. But I don't know why we wouldn't at least evaluate whether or not there's a willing buyer, willing seller situation."

Q: How would you describe the mood in Congress now that a new president has taken office?

A: "Donald Trump said throughout the campaign that when he came to office, he was going to roll back a lot of the executive orders that Joe Biden put into place. And of course, I've grown increasingly uncomfortable with all of these executive orders that these presidents put out there because I think Congress should be making the laws. And so I think it's refreshing to see the president roll back some of these Biden executive orders, in essence undoing a wrong. ... I think that the mood in Congress is one of enthusiasm and excitement. I think we know that there is a real possibility that Congress will be able to pass legislation that secures the border and is bipartisan, and to roll back regulations. I think we will have a number of bills that roll back regulations, that will pass on a bipartisan basis, overwhelmingly. ... You get a certain amount of outrage around Donald Trump. That is indeed for political purposes rather than for legitimate policy concerns."

Q: What impact do you expect to see from Trump's plan to impose new tariffs on imports from Canada, Mexico and China?

A: "One thing that the Trump administration said, even in the information they've released to the public, they use the word 'leverage.' I think they are interested in making sure that we have, No. 1, a fair trading relationship with other countries, and No. 2, that those countries are doing what they can to stop the flow of poison, fentanyl and (methamphetamine), into this country. And so it seems to me that the president has been very clear that these are areas where he wants to have leverage in conversations with these countries. And I do think there are ways in which targeted tariffs can be helpful in building some domestic industry. Clearly, you can overdo tariffs too. I mean, this is a policy tool that I think Donald Trump understands can be used for leverage can be used in a targeted way. Those would be the most effective ways to make sure that we make America stronger. I mean, how much did the Trump tariffs contribute to inflation in his first term? It was the lowest rate of inflation in modern economic history. The real wages were growing at twice the rate of inflation, which is remarkable. Wage growth was growing at twice the rate of inflation, and Trump certainly used tariffs in targeted ways in his first term, in ways that did not contribute to widespread inflation. Again, I think it's not to look at a tool as inherently good or inherently bad. We want to look at it like a lot of tools, which is, 'OK, how do you use this tool in the most productive way?'"

Q: How do you feel about Trump's pardon for almost all the Jan. 6, 2021, rioters who stormed the Capitol in Washington?

A: "We shouldn't be condoning violence. Clearly, I think I would view people who trespass differently than people who attack police officers. One thing we know is that the Constitution gives the president unilateral power in that way. And I was, of course, disappointed when President Biden gave a blanket and probably the most sweeping pardon in American history to his son. And so I understand why people wonder if this pardon power that we give the president and the Constitution is perhaps too broad. ... Of course, we should not condone those who commit violence against police officers. And I think Americans are right to wonder whether or not the power, the pardon power, as it exists in the Constitution, if that's a little too broad. I think what Joe Biden did with his son was concerning, and I can understand why others feel that way about the Jan. 6 pardons."

Q: What's the next step for you in your career?

A: "Let's go get the reconciliation package we're working on the House done. I mean, let's make sure we don't increase taxes on American families by $5 trillion, and let's make sure we secure the border and let's make sure we roll back regulations. There will always be time to play politics. There will be time for me to play politics down the road. I've just got to be focused on getting our job done. I mean, we are 12 days into Donald Trump's term. I think South Dakotans could rightfully be a little irritated if I was already looking toward the next election."

PRESENTATIONS

Amanda Halsey, Register of Deeds, gave a briefing on the Register of Deeds Office. As the official records office of the county, the office records, maintains, and archives many different land and personal property records along with the issuance of birth, death, and marriage records as well as the issuance of marriage licenses. The Register of Deeds office provides revenue for the county through the collection of transfer fees, recording fees, copy fees, and the issuance of marriage licenses. In 2024, the office recorded over 23,000 documents affecting real estate, sold 1,749 marriage licenses, and issued over 22,000 copies of birth, marriage, and death certificates. Register of Deeds Halsey went on to highlight the fee structure that is used by the office and how the fees are split. Finally, the presentation highlighted the Document Pro update, which went live on November 15, 2024, and moves forward the update to completely move away from the AS400 program as well as providing a new robust search function for researchers.

Jamie Gravett, Juvenile Detention Center Director, gave the annual presentation on the Juvenile Detention Center. The presentation focused on the challenges, numbers, and good news at the Juvenile Detention Center. The challenges for 2025 include violent youth, special needs youth, and staff turnover. In 2024, there were a total of 1,615 intakes along with the bed days used were 10,985. Minnehaha County used 63% of the beds in the past year, while other counties used 24% and the Department of Corrections used 13% of the beds. The average daily population for Minnehaha County was 18.89 days. Director Gravett highlighted the following good news for the past year, including the construction of the new facility, transition team, and medical and dental services as well as the community partners. Finally, Director Gravett highlighted the work of the staff at the Juvenile Detention Center for their professionalism and dedication.

PER DIEM AGREEMENTS

Jamie Gravett, Juvenile Detention Center Director, presented an agreement between Minnehaha County, Lutheran Social Services, and seventeen (17) partner counties for juvenile housing services. Lincoln County agreement also includes a per diem for Community Supervision services and the Evening Report Center. The daily rate for the JDC is set at $497.80 per bed, per day. The rate for Shelter Care will be $296.14 per bed, per day. The daily rate for Community Supervision is $80.13 per day. The rate for the Evening Report Center is $55.57 per day. MOTION by Beninga, seconded by Bleyenberg, to Authorize the Chair to Sign the 2025 Juvenile Detention Center Per Diem Contracts for Juvenile Housing Services Between Minnehaha County, Lutheran Social Services, and the Following Counties Beginning on January 1, 2025, and Ending on December 31, 2025: Bon Homme, Brookings, Charles Mix, Clay, Davison, Hanson, Hutchinson, Jerauld, Lake, McCook, Miner, Moody, Turner, Union, Yankton, and Pipestone County, MN. By roll call vote: 5 ayes.

MOTION by Beninga, seconded by Heisey, to Authorize the Chair to Sign the 2025 Juvenile Detention Per Diem Contract for Juvenile Housing Service, Community Supervision and Evening Report Center Between Minnehaha County, Lutheran Social Services, and Lincoln County Beginning on January 1, 2025, and Ending on December 31, 2025. By roll call: 5 ayes.

BID RESULTS

Mark Kriens, Director of Facilities and Construction, reported on the bid opening for Courthouse Fire Alarm Replacement held on January 15, 2025. The following bids were received: Muth Electric with a total bid of $939,520.00; Electric Supply Company with a total bid of $912,915.00; and Electric Construction Company with a total bid of $862,323.00. Director Kriens confirmed with the Auditor's Office that funding is available to cover the cost of this project and will be included in the supplement request presented in March. MOTION by Beninga, seconded by Bleyenberg, to Approve Bid Results and Award Recommendation for the Courthouse Fire Alarm Panel Replacement Project and Authorize Chair to Sign an Agreement with Electric Construction Company. By roll call vote: 5 ayes.

Mark Kriens, Director of Facilities and Construction, reported on the bid opening for the Old Courthouse Museum Roof Repairs held on January 8, 2025. The project consists of a base bid for slate shingle replacement as well as alternates for window and sealant replacement. There was one sealed bid submitted from APX Construction Group with the following bid summary: Base bid in the amount of $857,500.00; Alternate 1-Dormer Window Replacement in the amount of $182,200.00; Alternate 2-Replace Sealant Joints at Existing Dormer Windows in the amount of $63,200.00; Alternate 3-Repoint Masonry Joints and Replace Sealant Joints in the amount of $223,400.00; Alternate 4-Replace Sealant Joints at Existing Louvers and Windows in the amount of $34,700.00. The alternates were utilized for the bid to give options to reduce the cost of the project. After further inspection of the building and the estimated mobilization and construction cost associated with the work, Director Kriens recommended the acceptance of the base bid along with alternates 1 and 3 for a total of $1,263,100.00. BRIDGE REINSPECTION PROGRAM RESOLUTION FOR USE WITH SDDOT RETAINER CONTRACTS

WHEREAS, 23 CFR 650 Subpart C, requires initial inspection of all bridges and reinspection at intervals not to exceed two years with the exception of reinforced concrete box culverts that meet specific criteria.   These culverts are reinspected at intervals not to exceed four years.
    THEREFORE, Minnehaha County is desirous of participating in the Bridge Inspection Program.
    The County requests SDDOT to hire Civil Design, Inc. (Consulting Engineers) for the inspection work.  SDDOT will secure federal approvals, make payments to the Consulting Engineer for inspection services rendered, and bill the County for 20% of the cost.  The County will be responsible for the required 20% matching funds.

EQUITABLE SHARING AGREEMENT

Joe Bosman, Captain, presented an annual agreement to participate in the Department of Justice Asset Forfeiture Program. The program allows participants to receive a share of federally forfeited proceeds that may be used for law enforcement purposes. The forfeited cash and property are from cases involving illegal activities, such as white-collar crimes, that would provide financial gain to the criminals. MOTION by Kippley, seconded by Beninga, to Authorize the Chair to Sign the Annual Equitable Sharing Agreement and Certification Form as part of the Department of Justice Asset Forfeiture Program. 5 ayes.

GRANT APPLICATION

Joe Bosman, Captain, requested authorization for the Sheriff's Office to apply for the 2025 Homeland Security Grant. The grant program provides funding for the purposes of enhancing the ability of local, state, and federal agencies to maximize their ability to prevent, respond, and recover from major events such as terror attacks, major disasters, and other emergencies. Minnehaha County Sheriff's Office and Emergency Management have participated in this grant each year for several years. Items purchased with the funds awarded have been very beneficial to our agency by increasing our preparedness. Specific award amounts are not known at this time due to the Sheriff's Office and Emergency Management still discussing our needs and Homeland Security has not released how much money each region will be allocated for projects. MOTION by Bleyenberg, seconded by Kippley, to Authorize the Sheriff's Office to Apply for the 2025 Homeland Security Grant. By roll call: 5 ayes.

AMERICAN RESCUE PLAN

Susan Beaman, Finance and Budget Officer, presented a briefing regarding the 2024 4th Quarter American Rescue Plan Expenditures. The Auditor's Office plans to report to the US Treasury regarding last quarter's expenditures of $2,206,833.12. The expenditure breakdown as follows: Jail Staffing for COVID Isolation Unit had an expenditure of $226,970.81; Retention Bonus had an expenditure of $23,683.00; Burials had an expenditure of $68,000.00; Motels had an expenditure of $12,331.18; Jail Booking Registered Nurse had an expenditure of $94,963.68; Jail Mental Health Counselor had an expenditure of $12,623.48; New Positions had an expenditure of $499,879.92; Welfare Rent had an expenditure of $155,650.64; Welfare Utilities had an expenditure of $13,136.82; Mortgage Assistance had an expenditure of $1,968.86; Emergency Response Infrastructure Improvements had an expenditure of $300,292,72; Juvenile Detention Center-Psychiatric Services had an expenditure of $14,095.00; Triage of Mental Illness Holds had an expenditure of $70,000.00; ‌Salary ‌Increase to Improve Worker Retention had an expenditure of $403,723.00; and Human Services Staffing had an expenditure of $309,564.01. The total ARPA expenditures through ‌December 31, 2025, were $36,414.189.02. As of December 31, 2024, $1,099,825.98 remains for obligated projects. These projects include Emergency Response Infrastructure Improvements, Construction of ‌an Additional Courtroom, and Building Ventilation Improvements and it is anticipated that those projects will be completed by the end of 2nd quarter of 2025. 

LEGISLATIVE BRIEFING

Meredith Jarchow, Assistant Commission Administrative Officer, provided an update for the 2025 Legislative session. Some important dates to note regarding the Legislative session are February 5, which is the last day for introduction of individual bills and resolutions; February 6, which is the last day for introduction of committee bills and resolutions; February 24, which is the last day to move required delivery of bills or resolutions by a committee to the house of origin; and February 25 which is the last day to pass bills or joint resolutions by the house of origin (Crossover Day). The briefing went on to summarize the legislation that the Commission Office is following. The briefing included information on the following House Bills (HB) 1103, 1107, 1119, 1125, 1126, 1127, 1156, 1157, 1190, and 1194. HB 1103 would modify the voter registration deadline. HB 1107 would prohibit natural asset companies. HB 1119 would limit annual valuation increases on owner-occupied single-family dwellings and nonagricultural property. HB 1125 would create a share the road emblem specialty plate. HB 1126 would modify provisions pertaining to the compensation of a recount board. HB 1127 would require that notice of a county's canvass, post-election audit, and test of automatic tabulating equipment be posted to the Secretary of State's website. HB 1156 would provide for the administrative approval of certain drainage applications by counties. HB 1157 would remove the maximum fee limit due when applying for a county drainage permit. HB 1190 would require ownership disclosure for any non-individual entity that exercises eminent domain. HB 1194 would authorize the cooperation of counties for purposes of operating the office of county director of equalization. The briefing went on to highlight the following Senate Bills (SB) 14, 95, 101, 103, 104, 105, 121, 124, 128, 131, 135, 139, 140, 141, 157, 169, 173, and 185. SB 14 would revise and repeal provisions related to agricultural production facilities and to provide a penalty therefor. SB 95 would make an appropriation to the Department of Revenue for distribution to county rural access infrastructure funds and to declare an emergency. SB 101 would provide a tax credit to limit the taxes due on property over the previous year. SB 103 would prohibit the use of vote centers in a county. SB 104 would provide for the publication of the cast vote record of automatic tabulating equipment and to make an appropriation therefor. SB 105 would establish election day as a legal holiday. SB 121 would reduce maximum values for certain property taxes levied on owner-occupied single-family dwellings, and to increase the rates for certain gross receipts taxes and use taxes. SB 124 would establish the Incarceration Task Force. SB 128 would amend requirements for an official newspaper. SB 131 would establish an electronic system for vehicle titles. SB 135 would exempt a motor vehicle insurer from a certain title fee. SB 139 would revise death reporting requirements. SB 140 would revise a provision related to the reimbursement of expenses incurred by a county in detaining a parolee. SB 141 would distinguish between new construction and improvements to existing structures for purposes of calculating increases in revenue payable from property taxes. SB 157 would require proof of workers' compensation insurance for contractors of public improvements and to establish procedures for verifying workers' compensation coverage and premium payments. SB 169 would require that taxing districts hold a public hearing when increasing property tax revenues relative to the previous year. SB 173 would revise the process by which a recount may be requested. SB 185 would amend the process by which the address of a registered voter is verified.

Commissioner Kippley provided an update regarding the Lincoln County Public Defender Officer that he has been involved with. 
    Commissioner Heisey provided an update regarding the transition to the vehicle registration system for the Treasurer's Office in mid-February and the need for repairs to the Old Courthouse Museum.
    Commissioner Karsky provided an update regarding the Juvenile Justice Center construction project.

The City Council of the City of Garretson, Minnehaha County, South Dakota met in regular session on Monday, February 3rd, 2025, at 6:30 p.m. at Garretson American Legion with Mayor Bruce Brown presiding.

  Code Enforcement – Hofer gave update on behalf of officer.

  Economic Development – Fields gave update on advertising plan and efforts.  Announced annual meeting date as March 24th 2025

  Emergency Services (Garretson Fire, Minnehaha CO Sheriff, Garretson Ambulance) – no one in attendance for GFD. Sheriff Deputy introduced himself and opened the floor to questions. 27 calls in 2025 for Garretson ambulance.

ORDINANCE NO. 712

AN ORDINANCE OF THE CITY OF GARRETSON, SD, AMENDING THE MUNICIPAL ORDINANCES OF THE CITY OF GARRETSON, SD, BY AMENDING TITLE 7, TRAFFIC, CHAPTERS 74.30 BICYCLES AND ALL-TERRAIN VEHICLES; 74.31 BICYCLE OPERATION REQUIREMENTS; 74.99 PENALTY

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF GARRETSON, SD:

That Section 7-74.30 to 74.99, of the Municipal Ordinances of Garretson, SD, is hereby amended to read as follows:

OFF-ROAD VEHICLES

74.30 DEFINITIONS

For the purposes of this article, the following terms, phrases, words and their derivations shall have the meaning given herein:

OFF-ROAD VEHICLES: means any self-propelled, two or more wheeled vehicle designed primarily to be operated on land other than a highway and includes, but is not limited to, all-terrain vehicles, dirt bikes, dune buggies, and any vehicle whose Manufacturer’s Statement of Origin (MSO) or Manufacturer’s Certificate of Origin (MCO) states that the vehicle is not for highway use. Off-road vehicle does not include a farm vehicle as defined in SDCL § 32-3-2.4. (Definition provided by SDCL § 32-20-1(4)). 

UTILITY: means any provider of electric, gas, water, sewer, pipeline, or telecommunications service. 

NORMAL AGRICULTURAL OPERATION: means operation of an off-road vehicle by a person engaged in a reasonably necessary agricultural related activity. 

74.31   REGULATIONS

A. PROHIBITION

Off-road vehicles shall not be operated in the City limits of the City of Garretson unless authorized pursuant to § 74.16 or § 74.17 of this code or licensed to be used on a public highway pursuant to SDCL § 32-20-13 or § 74.03 of this code and provided that such vehicle operated by a licensed operator, and only on surfaces maintained as a roadway or alley.

B. EXCEPTIONS

This Ordinance shall not prohibit off-road vehicles from being operated within the City limits of Garretson:

1. While on private property with the owner’s permission;

2. While engaged in normal agricultural operations;

3. While engaged in official maintenance activities for the City of Garretson or any utility company; or

4. While having been authorized by the City Council or City Administration.

74.99 PENALTY

In addition to any other penalty authorized by State law or City ordinance, each violation of this Ordinance subjects the individual to a fine of one hundred ($100.00) dollars.

This ordinance shall be in full force and effects from and after its approval, adoption and publication as provided by law.

The President of the Council, in the absence of the mayor, shall be the presiding officer of the Council and during the absence of the mayor, or in the event of his temporary disability, the President shall be acting Mayor and possess all powers of the mayor.  In the absence or disability of the Mayor and President of the Council, the Vice President shall perform the duties of the Mayor and President of the Common Council.

City Council President and Vice President:

At the first regular meeting after the annual election in each year and after qualification of the newly elected Aldermen, the common council shall elect from among its own members a President and Vice President who shall hold their respective offices for the municipal year.

Duties and Powers of the Council:

The mayor and city council shall have the duties and powers as prescribed by the laws of the State of South Dakota, the ordinances of the City of Garretson, and any other motion or resolution made by the City Council.

Office of the Mayor:

The mayor shall be elected for a term of two years or until his successor is elected and qualified. 

Mayor and City Council:

The City of Garretson shall be governed by a Mayor and six Aldermen, these people shall be called the governing body or City Council.

Agenda:

The mayor or any two city council members may submit to the city finance officer any business that they feel should be deliberated upon by the city council. The submission will be considered valid if it is submitted to the city finance officer in writing one week prior to the council meeting. Upon a valid submission, the city finance officer shall add the requested business to the agenda of the next city council meeting.

Adoption of Robert’s Rules of Order:

Meetings shall be governed by Robert’s Rules of Order Newly Revised 12th Edition and these council rules of procedure. In case of conflict, the council ordinances or resolutions shall prevail.

RESOLUTION #2025-3

WHEREAS, to provide for the orderly residential growth of the City of Garretson, the council hereby provides that the city engineer shall conduct a residential housing/infrastructure study on the land south of the current end of Main Avenue commonly referred to as the “South Main”.

During the study special consideration will be given to residential housing, recreational land (parks), and mixed commercial uses. Input on decisions will be taken from the city council members, utilities superintendent, and building inspector. Although all final decisions will be made by the city council members. At the completion of the study the city will be provided with a development concept with proposed project phasing, preliminary cost estimates, and prospective funding alternatives. The final concept and supportive materials can be utilized to inform future decision making and/or aid in marketing the development and associated properties.

If the Garretson city council does not select an appointed engineer by February 7th, the council’s finance committee shall be vested with the decision of which engineering firm will be used for this project.

NOW THEREFORE, be it resolved by the City Council of the City of Garretson, that a residential infostructure study pursuant to all the previously stated provisions shall be conducted.

RESOLUTION 2025-4 BRIDGE REINSPECTION PROGRAM RESOLUTION FOR USE WITH SDDOT RETAINER CONTRACTS

WHEREAS, 23 CFR 650, Subpart C, requires initial inspection of all bridges and reinspection at intervals not to exceed two years with the exception of reinforced concrete box culverts that meet specific criteria.  These culverts are reinspected at intervals not to exceed four years.

THEREFORE, the City of Garretson is desirous of participating in the Bridge Inspection Program using Bridge Replacement funds.

The City requests SDDOT to hire HDR (Consulting Engineers) for the inspection work.  SDDOT will secure Federal approvals, make payments to the Consulting Engineer for inspection services rendered, and bill the City for 20% of the cost.  The City will be responsible for the required 20% matching funds.

This project consists of approximately 775 miles of retracing existing pavement markings and placing pavement markings on newly resurfaced roadways in 16 counties in Southeast South Dakota. These counties include: Bon Homme, Brookings, Charles-Mix, Clay, Codington, Douglas, Kingsbury, Lake, Lincoln, McCook, Miner, Minnehaha, Moody, Turner, Union, and Yankton. The history of Garretson begins just down Split Rock Creek in a village first called Pleasant Valley, later renamed Palisades. This small settlement experienced significant growth throughout the 1870s and 1880s, with the establishment of a feed mill, post office, a small silver mine, and several other buildings.

In 1888, the Willmar and Sioux Falls (WSF) Railway, under the direction of James J. Hill and his Great Northern Railway, completed a line through Palisades from Minnesota. In 1889, the Sioux City and Northern Railroad sought to connect its railway from Sioux City to the WSF line. Initially, this junction was planned for the newly founded village of Sherman—named after E.A. Sherman, who financed the WSF line—which would have benefited both Sherman and Palisades. However, investors such as A.S. Garretson of Sioux City, IA, advocated for relocating the rail intersection to land they owned north of Palisades.

To maximize the value of the land that would now feature a triangular railroad junction, business owners in Palisades were offered free building sites if they relocated their establishments to the new railroad junction. This led to the formation of a new town—Garretson—in 1889, marking the end of the village of Palisades. The community was officially incorporated in 1891, and many original buildings relocated from Palisades still stand in Garretson today.

In its early years, Garretson rapidly developed into a thriving railroad town, soon boasting two hotels, two banks, two lumberyards, an opera house, and even a cigar factory—all fueled by the prosperity of the railroad. The Garretson public school was established early in the town’s history and remains a leader in education and athletics in the state. After World War I, the American Legion Henry G. Fix Post #23 was founded in Garretson, named after the first Garretson resident killed during the war. The Legion has remained a cornerstone of the community ever since.

Though it happened many years before Garretson was established, one of the community’s most famous legends involves outlaw Jesse James and his daring escape at Devil’s Gulch. In 1876, the James-Younger Gang attempted to rob the First National Bank in Northfield, MN. Frank and Jesse James fled west toward the Dakota Territory when the attempt failed. As the pair neared present-day Garretson, a pursuing posse picked up their trail, forcing the brothers to split up.

According to legend, Jesse was cornered at a deep chasm along Split Rock Creek. With the posse closing in, he turned his horse, spurred it forward, and miraculously leaped across the 20-foot gorge. His pursuers were left behind, and Jesse eventually reunited with Frank. The story goes that the brothers hid in the area for several days before craftily returning to Missouri. Jesse James was ultimately gunned down in 1882, but his legend lives on in Garretson.

Today, Devil’s Gulch is a public park that attracts thousands of visitors worldwide. Garretson celebrates its connection to the infamous outlaw every June with its annual Jesse James Days festival. In addition to Devil’s Gulch, Garretson is home to two other popular public parks. Split Rock Park is a local favorite for fishing and camping, featuring a 1930s W.P.A.-built overflow dam and bathhouse. The third park on the site of the former village of Palisades later became state property and was transformed into Palisades State Park, one of the most popular state parks in South Dakota for camping, hiking, and rock climbing.

Today, Garretson is home to 1,228 residents, maintaining its rich history and strong sense of community.
